The Benicia High girls tennis team defeated Berean Christian on Tuesday afternoon 4-3 to move into first place in the Diablo Athletic Leagu.

The Panthers were led in the win by No. 1 singles player Natalie Anaya, who defeated Chloe Larner, 6-0, 6-0.

Benicia, which moved to 5-0 in the DVL, lost the rest of the singles games but were able to pull out a win due to the wins from the doubles teams. The combo of Gaelen Ancheta and Jordan Sevier won 4-6, 6-2, 10-7, while Mandi Luellen and Megan Foon won 6-3, 6-0. Avalyn Phan and Imara Irakawa won by default.

“The match was highlighted by our doubles teams, they played well, especially our No.1 doubles who made adjustments after losing the first set,” Benicia head coach Michele Reyes said. “From last year Aubrey continues to improve. Yesterday she got off to a slow start, lost the first set, settled down and I believe if she had won the second set tiebreaker would have won the third set. Overall the team has depth and has fun.”

Singles wins came from Zophia Santiago, Jazmine Santiago, Raven Guilas and Marguerette Bui.

Bethel also had doubles wins from Vy Tran and Kayla Domingo, Tamyah George and Jesaleia Adena, and Kamri Cruz and Heena Bharti.

Court: Extraordinary damages OK in ‘wrongful life’ case – ABC News

SEATTLE — The Washington Supreme Court says that under state law, it’s OK for judges to award extraordinary damages in so-called “wrongful life” cases where a child has birth defects or disabilities that require extensive care.

The unanimous decision Thursday came in the case of a woman who became pregnant in 2011 after a federally funded health clinic mistakenly gave her a shot of flu vaccine instead of the contraceptive Depo-Provera. Her child was born with a condition that causes cognitive delays, slowed speech and language skills, epilepsy and vision problems.

Following a trial in 2020, U.S. District Judge Robert Lasnik awarded the child, Sandra, and her parents, Yesenia Pacheco and Luis Lemus, $10 million — $7.5 million for her medical, educational and other expenses, and $2.5 million in damages for her parents.

The federal government was ordered to pay the damages because the Neighborcare clinic is federally funded and serves low-income patients.

The Justice Department appealed to the 9th U.S. Circuit Court of Appeals. It argued that because the woman did not seek birth control specifically to prevent the birth of a child with congenital defects, that wasn’t a foreseeable outcome of the clinic’s negligence. Nor were the child’s disabilities caused by the clinic’s negligence, the DOJ claimed.

The government said it should be liable only for costs associated with the pregnancy and birth — about $42,000 — not damages for ongoing care and expenses following that birth.

The 9th Circuit asked the Washington Supreme Court to clarify state law regarding negligent reproductive health care, and in a 9-0 decision authored by Justice Mary Yu, the court rejected the government’s arguments.

Yu noted that a birth is a foreseeable outcome of a pregnancy, and that some children are born with congenital defects, so that was foreseeable, too. Washington is “one of the few states that recognize a broad range of claims by both parents and children,” Yu wrote.

The 9th Circuit still must determine whether Lasnik’s decision should be affirmed, but Mike Maxwell, an attorney for the family, said the ruling should all but end the case after seven years of litigation. He criticized the government for bringing the appeal.

“I don’t know what’s left to argue about,” he told The Associated Press. “This whole appeal has served no purpose other than delaying her care and further injuring this child. It’s been a long road. The government needs to pay.”

The U.S. Attorney’s Office in Seattle did not immediately issue a response to the ruling or to Maxwell’s criticism.

The child, who turned 10 this month, continues living with her parents in the Everett area, Maxwell said. She is mostly blind, suffers seizures, falls often and is “horribly disabled,” but without the damages awarded by the court being actually paid, her mother and father — who work in fast food and as a janitor, respectively — have been unable to afford care for her.

Pacheco is an El Salvadoran refugee who moved to the U.S. when she was 16. She had gone to the clinic for a quarterly injection of Depo-Provera, a hormone used for birth control, but a medical assistant who had been administering walk-in flu shots all day gave her the flu vaccine instead.

The clinic didn’t inform Pacheco of the error until she called to make her next appointment. By then, she was pregnant.

The justices also used the opinion to disavow demeaning terminology the Washington Supreme Court used in prior rulings concerning children with birth defects.

“It is both incorrect and harmful to refer to any person as ‘defective’ or to suggest that a child with congenital defects is not ‘normal,’” the court said.

“For decades, corporations misled us about their massive impact on climate change,” Liss-Riordan says in the ad. “In Massachusetts, we’ve passed good laws to hold big polluters accountable. But laws don’t enforce themselves.”

She promised to stand up to corporate polluters and “lead the national fight against climate change.”

In their letter, eight environmental advocates — including George Bachrach, the former president of the Environmental League of Massachusetts, and John DeVillars, a former regional administrator of the Environmental Protection Agency — accused Liss-Riordan of inflating her environmental record.

“You were not with us when we fought for the ‘good laws to hold polluters accountable,’” they wrote. “You were not with [Attorney General] Maura Healey and other litigators in court holding polluters like ExxonMobil accountable.”

They added: “Over more than two decades we never once saw you at the court house or the State House … Yet you run this TV ad claiming your twenty years as a private litigator demonstrates leadership on the environment … when you were needed in the court house or at the State House, you were missing in action.”

Kevin Ready, a spokesman for Liss-Riordan, called the allegations against her a “politically motivated attack” and accused the advocates of doing dirty work for her opponents, particularly former Boston city councilor Andrea Campbell.

“As this race gets closer and Shannon moves up in the polls, we expect to see more desperate ploys like this from our opponents,” Ready said.

Campbell has led the race for months, buoyed by name recognition from her candidacy in last year’s mayoral campaign in Boston. But Liss-Riordan, who has spent significant amounts of her own money on TV ads and direct mail this summer, has surged in the polls.

MassINC Polling Group recently found Campbell leading the race with 28 percent of those polled. But Liss-Riordan trailed by just 2 points, well within the poll’s margin of error. Quentin Palfrey, who ran for lieutenant governor in 2018 and is also now in the race for attorney general, had 10 percent.

Ready noted the ad was no longer airing on TV, though it remains online.

“These antics should not distract from the fact that one candidate in this race, Andrea Campbell, continues to accept money from fossil fuel industry lobbyists, despite pledging not to,” Ready said.

In June, Liss-Riordan accused Campbell of accepting campaign contributions from a lobbyist for ExxonMobil.

Campbell’s campaign declined to comment on that Friday.

In a statement, Palfrey said: “I am proud of our campaign’s plan to inject urgency into the fight against climate change,” noting he was endorsed by the environmental groups 350 Mass and the Massachusetts chapter of the Sierra Club.

During a candidates’ debate this month, Liss-Riordan called Campbell’s donor list “a who’s who of lobbyists for fossil fuel industries (and) the Koch brothers,” according to the State House News Service. Palfrey alleged Campbell “received $2 million in super PAC support in last year’s mayor’s race.”

During the debate, Campbell responded by saying Palfrey was relying on public matching funds and Liss-Riordan was financing her campaign with some $3 million of her own money.

“I’ve always been accountable to the people,” she said, according to the State House News Service. “I will remain accountable to the people.”

Ready described Liss-Riordan as “by far the most qualified candidate for attorney general to use the law to take on those who are destroying our environment and contributing to climate change.” He noted that she has also proposed setting up a “Green Bank” to help finance environmental justice projects.

In response to the allegations, he noted that Campbell was being supported by the Environmental League of Massachusetts Action Fund.

Bachrach, who retired from the Environmental League of Massachusetts, said he has no connection to the Campbell campaign.

“While I left ELM five years ago, the endorsement of Campbell by environmental groups is based on her record,” he said.

In their letter, the environmental advocates accused Liss-Riordan of seeking labor endorsements from “those eager to build gas pipelines that will prolong our dependence on fossil fuels.”

“It is cynical, deceiving, and offensive to those of us (and thousands of others) who were in the climate trenches, for you to take any credit on the environment,” they wrote.

The letter was also signed by Kelsey Wirth, cofounder of Mothers Out Front; Jack Clarke, former legislative director for Mass Audubon; Bob Massie, who has led several environmental groups and was a former candidate for governor; as well as longtime environmental advocates Sonia Hamel, Christina Pacheco, and Thaleia Schlesinger.
