At least 24 people have been killed after a bus in Peru veered off a mountainous road and plunged down a slope.

The bus had been travelling north from Ayacucho in the south-central part of the country to Huancayo, the capital of the Junin region, when it crashed around 1:30am local time (06:30 GMT) on Monday.

Local media reported that the bus flipped several times as it tumbled down the rugged mountain terrain in the area of Huancavelica.

Manuel Zevallos Pacheco, the mayor of the Anco district, told the news outlet RPP that the bus fell at least 150 metres (492 feet).

The regional government of Ayacucho reported that it had attended to 11 injured passengers at the Huanta Support Hospital. The newspaper La Republica estimated that as many as 36 people could be wounded.

Peru’s transportation authority, SUTRAN, issued a statement on Monday offering condolences for the dead and pledging to probe what happened.

It added that, according to preliminary investigations, the bus had the proper authorisation to transport passengers: It had its mandatory accident insurance and had passed a vehicle inspection.

“At this time, SUTRAN is continuing its investigations, as established within the framework of its powers,” the agency wrote, underscoring its “commitment to supervising compliance” with federal regulations.

The company that operates the bus route, Molina Union, confirmed the death toll to the Reuters news agency on Monday but declined to offer further details.

Monday’s crash is the latest deadly incident on Peru’s roadways, many of which have been built on the steep terrain of the Andes Mountains.

In January, a bus carrying 60 passengers dove off a cliff in northern Peru, killing at least 24 passengers, according to preliminary reports.

In 2021, a string of crashes occurred within a span of four days, including two involving buses. One plunged into a ravine in the country’s southeast, while another toppled off a cliff some 60km (37 miles) from the capital Lima.

Authorities investigating the latter said “recklessness” and “high speed” were contributing factors. Experts also have questioned whether the bus drivers navigating these winding mountain roads received proper training.

Meanwhile, in an interview with RPP, Mayor Zevallos Pacheco expressed frustration with the Ministry of Transportation and Communications, which he accused of not looking into a recent avalanche that took place on the same roadway where Monday’s crash took place.

“Practically as a result of this, we have an accident,” he told RPP.

The news outlet reported that traffic accidents have increased in Peru in recent years, with injuries climbing from 38,447 in 2020 to 53,544 last year. Traffic-related deaths also rose to 3,311 for 2022.

Dan Pacheco: A toolkit for assessing and making decisions on emerging technologies

Dan Pacheco is the Peter A. Horvitz Chair of Journalism Innovation at the Newhouse School at Syracuse University and author of the upcoming book, Experimenting With Emerging Media Platforms: Field Testing the Future. Speaking at FIPP World Media Congress 2023, Pacheco doubled down on the need for media companies to experiment, keep on experimenting, and then…..experiment some more.

“Our entire media ecosystem is built upon links … links might actually be on the way out.”

Attended by more than 400 delegates from 43 countries, the FIPP World Media Congress 2023 kicked off with a look at the innovation occurring in the face of severe media disruption.

During his keynote session, Dan Pacheco emphasised the need for publishers to step away from thinking that the internet is ‘just a bunch of rectangles’ and instead realise it is an interactive ecosystem where constant experimentation and innovation are a necessity.

Pacheco has a long history as an innovator in major media companies, and here he shares a toolkit for publishers to assess and make decisions on emerging technologies.

Here are a few key insights from the session:

1. “We always have to be experimenting”

“Very recently, Apple introduced the Apple Vision Pro. If you think back a few years ago, people were talking about the future as virtual reality and putting things on your face. Facebook created a product that really did put something on your face, but then you’re socially isolated. 

“And now Apple is basically saying, in 10 years, this tech will replace the iPhone. You can sort of see the evolution. So we always have to be experimenting with new technologies, and we have to make bets. We don’t have any choice over that. 

How do we predict the future? Most recently, virtual reality was sort of like on the way out. And then Apple completely changed all that.

2. The internet is becoming more interactive

“The internet got better and more social. And now what we’re seeing is it’s becoming more interactive. Stop thinking about the internet as being just a bunch of rectangles. And regardless of what you think about virtual reality or augmented reality, or what Apple calls spatial computing, all of the fabrics to make that work is already here.

“You’re probably already seeing more of this kind of content. It’s just getting more interactive, more and more immersive. But how do you as a media professional or media company decide what to do with that? And where do you put your eggs? 

When it comes to AI, I think this is the big question right here. How does my content work when AI generated answers are valued more than links to content? Our entire media ecosystem is built upon links. I think links might actually be on the way out.

3. “Innovation is … being a little bit ahead of everybody else”

“20 is basically the number that you need just to get a data sample that means anything. It shouldn’t be your friends and family. It shouldn’t be people you work with. It should be people in that target market. This is what tech companies do all the time in the background. You just don’t realize it. 

“They call that a pain point. So you find some pain that somebody has, and then you want the pain killer for that pain. If you can do that, you have a solution that’s going to have some longevity to it. What you learn by going through these experiments, sometimes you discover something that you didn’t even anticipate. And that becomes the true innovation. 

That’s actually where Twitter came from by the way, it was a little like side product in, I think a gaming company. If you’re 10% ahead, well, that’s innovation. Innovation is not, we’ve invented something totally new. It’s just being a little bit ahead of everybody else.

Swapping Debt for Nature: Does Ecuador Show the Way?

In the fringes of the opaque world of “innovative finance,” there is much excitement over recent efforts to swap the distressed foreign debt of less developed governments in return for a promise to protect biodiversity or “green the economy.” The excitement stems not the least from the fact that though debt-for-nature swaps had been experimented with as far back as the 1980s, only to lose momentum, there has been a sudden spate in such deals in recent times Belize concluded a deal in 2021 (involving bonds valued originally at $553 billion); Barbados struck a deal to buy back a fraction, valued at $150 million, of its outstanding bond debt due to mature in 2029 and 2043; Ecuador completed in May 2023 what is, thus far, the biggest debt-for-nature swap (involving bonds with a face value of $1.6 billion); and Gabon, most recently, clinched a deal in August 2023 buying back $500 million worth of bond debt.

Though still a small share of total external debt, the magnitudes involved in Belize, Ecuador, and Gabon are much higher than the deals struck in the past, and large enough to attract interest as a joint solution to debt stress and past and future environmental damage. Moreover, while the earlier deals involved, besides the debtor sovereign, official bilateral creditors and philanthropic institutions and non-governmental organisations (NGOs), the recent deals are led by private players, who both structure the deal as well as finance it. Historically, given the fact that less developed countries were hard put to service hard currency debt and much of the debt up for restructuring was in or on the verge of default, private players had no interest. In those circumstances, the effort was aimed at getting creditor governments to write off some of the debt or get NGOs backed by philanthropies to buy up distressed debt at a discount and write it off, and to get the debtor to spend all or much of the “savings” garnered through these means on conservation projects in local currency. The debtor was offered some debt relief but, more importantly, relieved of the burden of finding or diverting scarce foreign exchange to service the debt.

In the new wave of debt-for-nature swaps, private players have a dominant role to play. Debtor governments are helped by financial majors and influential “non-governmental” players (such as the Nature Conservancy) to borrow sums at much better terms than existing foreign debt to buy back a part of their more expensive debt at a discount. Interest rates on the new loans are much lower and maturity dates are postponed, giving the debtor relief and breathing space. Though the market here is the restructuring medium, government-sponsored and multilateral financial institutions from or backed by the developed countries step in to offer insurance or partial guarantees that substantially improve the ratings of the new bonds issued by the debt-stressed sovereign. With the risk associated with the instruments being taken over by these entities, the bonds are acceptable to investors at terms far better for the debtor than applicable on the debt being replaced or on past debt outstanding.

This ability of private facilitators to deliver debt relief, however limited, is attributed to the willingness of the debtor country to commit to use a part of the “savings” garnered from the discounted buyback of old debt and the low interest rate on the new debt on conservation or greening projects. As a result, the bonds issued to mobilise the new loan are designated as “blue” (marine conservation) or green bonds, even though not all of the resources mobilised are spent on blue or green projects. That designation helps find investors in the bonds, including insurance companies and pension funds, looking to enhance or widen their environment, social and governance (ESG) investment portfolio. Combine the blue bond designation with the reduced risk deriving from guarantees and insurance coverage and the extremely favorable terms at which the bonds can be placed is easily explained. But what advocates of these deals emphasise are the large savings for the distressed debtor and the green benefits for the international community, making it a “win-win” proposition.

A case in point is the biggest of these, recently announced by Ecuador in May 2023 and orchestrated by Credit Suisse, which, before its merger with UBS, had come to dominate the field. The deal has been headlined as one in which, in the process of restructuring distressed sovereign debt, resources have been freed up to support the newly established Hermandad Marine Reserve and the Galápagos Marine Reserve, as well as to fund an endowment for marine conservation. Overall, the Ecuadorian government has committed to allocate around $18 million a year for 20 years for conservation in the environmentally prized Galápagos Islands through a non-profit foreign endowment fund, the Galápagos Life Fund.

The deal as “structured” has components very similar to other deals arranged in recent times, including in Belize.1 It begins with leveraging bondholder fears resulting from the economic situation in Ecuador and the recent political uncertainty in which the opposition in the National Assembly was attempting to impeach the incumbent president, Guillermo Lasso, accusing him of embezzlement. That allowed arriving at a deal in which a combination of three sets of bonds of different maturity dates with a face value of $1.63 billion could be bought for just $656 million or at a discount of 60%.

To finance this buyback, the Ecuadorian government received an equivalent loan on much better terms (interest rate of around 7% as opposed to 16% on existing Ecuadorian debt and a grace period of seven years for capital repayments), from a special purpose vehicle (SPV) named GPS Blue Financing. GPS Blue, in turn, raised the requisite funds by issuing (in collaboration with Credit Suisse) “blue” “Galápagos bonds” that were insured in full by the US government-backed International Development Finance Corporation (IDFC) and partly reinsured by private reinsurers as well as a partial guarantee of $85 million from the Inter-American
Development Bank. This implied that not only were investors protected, but the bond issuer was covered as well, with risk being transferred to these state backed agencies, who justify their action as being aimed at de-risking environmentally positive instruments to attract private capital. A consequence of the de-risking support is that Moody’s could hand out an investment grade Aa2 rating for the bond, which was the agency’s third highest rating and 16 levels above the Caa3 junk rating that Ecuadorian sovereign debt was subject to. Not surprisingly, though the new bond offered a yield of just 5.6%, it attracted much interest, including from the likes of UK asset management major Legal and General, which snapped up $250 million of the issue and sent out a signal that bonds emanating from these kinds of complex deals are a good bet.

This, and deals in other countries like Belize, have been declared a “win-win” for countries facing sovereign debt distress, for private investors and for the international community concerned about biodiversity loss and climate change. But not so soon, argue the critiques.2 The question arises as to what drives the holders of bonds to sell them back to the government at a discount, or accept an “haircut,” which go as high as 60%. Second, what is in it for the private players such as Credit Suisse or Bank of America that makes them invest time and “expertise” to design and help complete these swap arrangements? Third, how come a debt-distressed country is able to issue new debt in the form of blue or green bonds that are placed at very favourable rates and terms? Fourth, how much is the debtor implicitly or explicitly paying out to utilise this swap? And, finally, how much of a conservation dividend does the operation provide?

The easiest of these questions to answer is the fi rst. The debt involved is a small fraction of the stock that was built when access to extremely cheap excess liquidity in the international system led to a supply-side push of capital into sovereign debt in the less developed countries, including the risky, so-called frontier markets.3 It soon became clear that much of this foreign debt to be serviced with hard currency was unsustainable even in normal times, let alone in a period marked by a pandemic, followed by rising interest rates and inflation led by speculation precipitated by the war in Ukraine. In the event, countries were hard put to service external debt, and the distressed debt was trading at a huge discount in markets. All it took to persuade the bondholders to sell that debt back to the debtor governments was to offer them a modest “premium” above these discounted prices. In fact, even after part of the debt was bought back, reducing supply in the market, the price of these bonds in secondary markets did not rise to equal the buyback price. Given the economic situation in the debtor countries, holding on to the bonds would have meant facing default and restructuring in due course. Accepting a haircut was much smarter.

For debtor governments, the buyback at what was a signifi cant discount, was a way of winning some relief from stress. However, the challenge they faced was one of finding the resources to finance the buyback given their fiscal and foreign exchange positions. It is here that the private agents like Credit Suisse (in Belize, Barbados, and Ecuador), and (after the Credit Suisse merger with UBS) Bank of America in Gabon, came in with their restructuring packages. They channelled to the debtor a loan needed to cover the discounted total cost of debt being bought back, at interest rates that were extremely favourable compared with that being paid on outstanding debt of the debt-stressed borrower, with grace periods and extended maturities that eased the servicing burden on the new debt.

Which brings up the second question being raised above: What prompted the likes of Credit Suisse that were offering their services to structure the deal to also advance a loan that was so favourable for an already stressed debtor? The answer lies in how the operation is structured. In both Belize and Ecuador, the blue bonds were insured by the US government-backed IDFC. This explained the favourable terms of the loans, benefits of which were partially passed on to the government.

In fact, the yield on bonds sold to investors were lower than that charged in the bond sale, the proceeds of which went to the government and the cost of which had to be borne by it. The loan to Ecuador carried a rate of 7%, while the blue bond was issued at 5.4%. That difference, even after accounting for premiums for insurance paid to IDFC and reinsurers and costs such as audit, accounting and rating agency charges, leaves a fat fee to be shared between the likes of Credit Suisse and the host of other private financial players and consultants involved. In Belize, Daniel Munevar estimates that a similar difference in interest rates delivers up to $84 million over the lifetime of the deal, which was close to 45% of the $190 million the country is estimated to have gained from the debt relief implicit in the discounted buyback of debt as well as the lower interest outflows on the new loan that financed that buyback.

Finally, while the blue bonds carry an implicit ESG tag, the justification for this on grounds of protection of nature are not warranted as just a little of the money conjured out of the exercise is allocated to that cause, and there is no identified means of verifying whether the promised conservation benef ts would actually be delivered. On the other hand, multiple layers of non-transparent transactions make the deal a winner for finance with some crumbs for the distressed debtor.

At fi rst sight, it appears that everyone has benef ted: governments from the discounted debt buyback financed with a loan on attractive terms; investors who get a reasonable return on an almost risk less, ostensibly ESG-compatible instrument, because of backing from IDFC and others; Credit Suisse from the spread and fee it receives by structuring the deal and other intermediaries from fees; and the rest of the world from the externalities associated with conservation of biodiversity. But what stands out in all of this is that the risks associated with loans sitting with a distressed debtor have not gone away they have just been taken over by the US government through the IDFC. Leveraging that contribution of the US government, private investors in the blue bonds have got themselves a good deal, and Credit Suisse and private “non profi ts” have fattened their bottom lines. However, the debt relief gains are limited and the conservation gains uncertain and unverifiable.

Bill would give LA County juvenile halls up to $1 billion in funding, if they aren’t shut down first – Daily News

A bill heading to Gov. Gavin Newsom’s desk could direct hundreds of millions of state dollars to Los Angeles County’s troubled juvenile halls, but youth justice advocates and two county supervisors are pushing for a veto, arguing it would waste money on a “very broken system.”

AB 695, introduced by Assemblymember Blanca Pacheco, would give the Board of State and Community Corrections — an agency that recently shuttered two of the county’s juvenile halls over poor conditions — the ability to provide state grants to Los Angeles County for infrastructure improvements, including the construction of new living quarters for youth in custody and modernized spaces for rehabilitative and educational programs.

The bill passed in the Legislature the same week that the BSCC warned it may be forced to close more of Los Angeles County’s juvenile facilities, including the newly reopened Los Padrinos Juvenile Hall, over failed inspections.

Though AB 695 doesn’t set a dollar amount, the Senate Appropriations Committee estimates the hit to the state’s general fund will be in the “high hundreds of millions” of dollars — potentially up to $1 billion — to address the “critical needs of the juvenile facilities in Los Angeles.”

Opponents worry that such a high level of funding will only make the county more reliant on its flawed Probation Department and the prison-like detention facilities that the county has pledged to replace — with little progress so far — with “less restrictive” alternatives.

‘Youth Justice Reimagined’

Instead, the juvenile reform advocates want to see L.A. County follow through with the implementation of Youth Justice Reimagined, a proposal unanimously approved by the Board of Supervisors in 2020. That plan would place youth in the custody of the newly created Department of Youth Development and dedicate resources to diversion and intervention programs, in-home confinement and the construction of smaller “safe and secure healing centers” spread throughout the county.

Two county supervisors and nearly two dozen advocacy groups, including the ACLU, opposed AB 695, arguing that such an investment into the juvenile hall system, which Youth Justice Reimagined wants to dismantle by 2025, will not address its failings.

“Funding infrastructure does not begin to approach the wholesale change that is needed in how we approach our justice-involved youth,” wrote county Supervisors Lindsey Horvath and Holly Mitchell, in a letter to the state Legislature. “A department with a record of mismanagement so severe that the State had to intervene should not be rewarded with taxpayer dollars.”

The county has invested $35 million in capital improvements over the past five years, yet conditions have become “so abhorrent,” largely driven by a high level of staff call-outs, that the county had to consolidate nearly 300 youth to Los Padrinos Juvenile Hall in Downey after the BSCC declared that Barry J. Nidorf and Central juvenile halls were not suitable for confinement of youth, according to the letter.

“A grant to improve a dwindling number of facilities your own corrections board has deemed ‘unsuitable’ for reasons that have little to do with the physical infrastructure would be better spent on efforts that would shift the culture to support developmentally appropriate rehabilitation rather than a punitive approach,” Horvath and Mitchell wrote.

3 supervisors support bill

Three other supervisors, all of whom also support Youth Justice Reimagined, have backed AB 695.

Supervisors Janice Hahn, Kathryn Barger and Hilda Solis, along with several construction and peace officer unions, wrote letters in favor of the bill.

“While the challenges our Probation Department face go far beyond the physical facilities, we still owe it to the youth who are in our care to make our probation facilities modern, safe, and comfortable,” Hahn said in an emailed statement. “The buildings at Los Padrinos are aging and they need upgrades. I want to see funding go toward improving the air conditioning, modernizing the classrooms, and making the rooms more comfortable.”

Despite the promises of Youth Justice Reimagined, state law places juvenile halls squarely under the control of the county probation officer and, thus far, attempts to change that law in the Legislature have been unsuccessful, meaning the Probation Department isn’t going anywhere yet.

What AB 695 will do

The Los Angeles County Probation Officers Union co-sponsored AB 695 and stated in an argument in support that it would be used to “construct a new training facility” needed by the department and “to renovate Central Juvenile Hall, Camp Joseph Paige or Dorothy Kirby Center, and Barry J. Nidorf Juvenile Hall.”

An improved physical environment will help motivate the young people to “change their lives for the better,” the union wrote in a letter in support.

“These facilities were constructed decades ago,” union officials wrote. “They are dilapidated, prison-like, and unsuitable for our collective vision to rehabilitate troubled youth and young adults. Nevertheless, we are doing our best with what we have, but our mission to provide second chances for youth and young adults in a trauma-informed, care-first setting is severely compromised with the current facilities.”

Los Padrinos, the county’s largest juvenile facility, originally opened in 1957.

A spokesperson for the union did not respond to a request for comment.

Too late to matter?

Aditi Sherikar, senior policy associate for the Children’s Defense Fund California, called the passage of AB 695 “very disappointing.” The county is less likely to transition away from juvenile halls as promised if it invests a billion dollars into them, she said.

She pointed to recent inspections by the BSCC that found both Los Padrinos and the Secure Youth Treatment Facility at Barry J. Nidorf out of compliance with state standards for juvenile facilities. None of the areas of noncompliance relate to infrastructure, according to an inspection report.

“We know the crisis facing youth in L.A. County has absolutely nothing to do with the buildings, the walls, the structures,” Sherikar said. “If the governor is serious about being responsible with taxpayer money, he will veto this bill.”

The county Probation Department already receives an annual budget of roughly $1 billion, with about half going to the juvenile side. Since 2019, the county has dropped from 19 juvenile camps and three juvenile halls to just six as of 2023.

Though those in custody once numbered in the thousands, the population has declined to less than 500 in recent years.

“LA County has poured resources into this department for decades, but conditions have only worsened despite year over year increases in funding,” stated an opposition letter from the Pacific Juvenile Defender Center. “AB 695 will only serve to bolster LA County probation’s dysfunction and abuse.”

Staffing issues persist

Los Angeles County’s Probation Department has struggled with crisis after crisis for years. Many of the department’s recent problems have been attributed to its struggle to get employees to show up for work. A report in July found that nearly a third of juvenile hall employees were on full-time leave. Recent inspections indicate there has not been enough of an improvement despite the county’s efforts to hire new probation officers and incentivize existing ones.

Both the Department of Justice and the BSCC have separately taken actions against the county over the poor conditions in the facilities.

In 2021, the Department of Justice sued and won a judgment against the county over its failure to provide appropriate educational, medical and recreational services to youth in custody. A judge agreed earlier this year to sanction the county if it doesn’t come into compliance with the terms of that judgment within the next few months.

Nearly 600 former detainees have filed lawsuits against the Probation Department since December alleging decades of sexual abuse in the juvenile halls and camps.

Troubles at Los Padrinos

In May, the BSCC ordered the county to shut down and empty Barry J. Nidorf and Central juvenile halls within 60 days, causing county officials to scramble to reopen Los Padrinos Juvenile Hall, which closed in 2019, to house the juveniles instead.

The hope of a fresh start at Los Padrinos dissipated quickly. Visitors during one of the first weekends complained of foul odors, bug infestations and a lack of activities for the bored and increasingly agitated detainees. Over the next two weeks, a gun was found unattended inside the facility, though firearms are prohibited even for law enforcement. Then, a coordinated group of detainees busted out of their rooms and attacked guards during an escape attempt.

One youth successfully scaled a wall before he was detained in a nearby golf course. Neighboring law enforcement agencies, responding to the call for help, arrived in riot gear and surrounded the facility, while news helicopters circled overhead.

In August, inspectors found that employees at the SYTF and Los Padrinos are still not completing safety checks frequently enough, conducting searches for contraband regularly, bringing youth to school on-time, or providing adequate recreation. Those same problems were flagged during inspections at Central and Nidorf in early 2023 and contributed to their closures.

“Even though these facilities are different than Central and Barry J. Nidorf Juvenile Halls, they are the same issues,” said Allison Ganter, the BSCC’s deputy director of facilities standards and operations, during a presentation at the board’s meeting Thursday, Sept. 14.

The BSCC, which will be tasked under AB 695 with supplying grants to Los Angeles County to improve its facilities, could end up shutting down the county’s two largest before a single dollar can be awarded.

The state regulatory agency has ordered L.A. County to submit plans to fix the problems at the SYTF and Los Padrinos by Oct. 10 and Oct. 17, respectively.

If the plans are not approved, or the county fails to implement changes within 90 days, those facilities could be declared unsuitable and forced to close by early next year.

Reservoirs in Andalucía continue to lose water and hold less than 20% of their combined capacity | Sur in English

The reservoirs in Andalucía are continuing to register a decrease in the volume of water held – despite the recent rains – and are currently below 20% of their total capacity, increasing the likelihood of future restrictions.

The region’s main water reserves are currently at 19.7% of their holding capacity, with 2,191 cubic hectometres, some 41 less than they stored a week ago. The water stored is 4.4% lower than last year.

According to the Ministry for Ecological Transition and the Demographic Challenge, the water stored in the reservoirs of the Guadalquivir basin has been reduced by 0.4% to 18.7% with a total of 1,501 cubic hectometres, while that of the Andalusian Mediterranean basin is down to 24.7% of capacity, with a total of 290 cubic hectometres.

The reservoirs in Huelva fell by three cubic hectometres to 131, with their reserve at 57.2% of their capacity, and those in Cadiz lost four hectometres to drop to 269, with a water level of 16.3%.

At a national level, the Spanish water reserve is almost double that of Andalucía, with 36.8% of its total capacity and it currently stores 20,623 cubic hectometres of water, decreasing in the last week by 111 cubic hectometres, or 0.2%.

Further water restrictions are a distinct possibility for Andalucía. The Junta has made it clear, however, that any water restrictions in municipalities would be addressed by the drought committees, with the involvement of the local councils.

The Minister for Sustainability, the Environment and the Blue Economy and spokesman for the Andalusian government, Ramón Fernández-Pacheco, said that “if the drought situation worsens in the coming months, the drought committees will be convened, with the involvement of both the affected sectors and the local councils”.

The Junta’s spokesperson stressed that ultimately the municipalities are responsible for water supply. He added that “the Junta would discuss with them any restriction measures within the framework of the drought committees, as the Andalusian government “will not be indifferent” to a problem of this magnitude.
