Stanley Black & Decker has agreed to pay up to $850,000 to settle a class action lawsuit brought by consumers who accused the company of failing to properly inform them of the expiration dates on organic bonded abrasive wheels — and those affected do not need proof of purchase to make a claim.

The Class is made up of anyone who purchased one or more DEWALT, Porter Cable, or Black & Decker brand organic bonded abrasive wheels from June 7, 2015, through Feb. 7, 2022.

Organic bonded abrasive wheels are cutting tools made of abrasive grains held together by organic materials such as rubber, resin, or shellac, according to Training and Assessment Consultants Ltd.

The plaintiff in the class action lawsuit alleged Stanley Black & Decker failed to provide adequate information regarding the abrasive wheels’ expiration dates. He argues he would have paid less for the products had he known this information.

Black & Decker has not admitted to any wrongdoing but has agreed to the settlement to resolve the plaintiff’s claims.

Under the terms of the settlement agreement, Class Members will be eligible to claim compensation. The amount they are eligible to receive will depend on which tier they belong to:

• Tier 1 claimants — those without proof of purchase — will be eligible to receive $2.50 per unit of covered product purchased, up to four units, for a total possible payment of $10 per household.
• Tier 2 claimants, or those who are able to provide proof of purchase, will be eligible to receive a refund of their total purchase price, up to a maximum of $50.

These amounts are subject to adjustment up or down, depending on the number of claims that are submitted.

A final hearing in the Black & Decker abrasive wheels settlement is scheduled for June 20, 2022.

The deadline for Class Members to exclude themselves from or object to the settlement is April 15, 2022.

In order to benefit from the settlement, Class Members must submit a claim form no later than May 2, 2022.
