It elicited giggles, but a Casper City Council member on Tuesday posed a legal question about whether users of a subscriber service featuring a lot of porn could face criminal charges in the proposed revised ordinance dealing with prostitution and human trafficking.
The revised ordinance, according to a memo from City Attorney John Henley, won’t stop human trafficking but it would give law enforcement a way to investigate and prosecute it and prostitution.
This was the third reading before the ordinance would take effect.
But Kyle Gamroth saw a problem with it.
One section of the revised ordinance had language about “performance prostitution,” Gamroth said.
“I was just curious, would that make somebody, like, if they were using an OnlyFans account or something to generate some revenue on the side, would that make that illegal,” he asked. “You know, if they were using that sort of phone application? Because I would be very hesitant to support something that, you know, criminalized someone using an OnlyFans account to generate some money on the side.”
Mayor Steve Freel asked Assistant City Attorney Wallace Trembath what he thought.
Trembath responded that he didn’t know what OnlyFans was.
A woman not shown on the city’s YouTube channel responded with one or two unintelligible words.

Freel said he was glad he wasn’t the only one who didn’t know.
Gamroth saiid he’s never used it, having been happily married for 10 years.

Although he’s never seen it, Gamroth said he understands that OnlyFans is an app to “transmit video of yourself doing things and get money in return for that. I don’t know what their stipulations are as a company; or an application of what you’re allowed to do and what you’re not allowed to do.”
Regardless, Gamroth said his understanding of the revisions to the public decency ordinance could be broad enough to criminalize private interactions that don’t involve a physical presence.
He does favor the ordinance’s emphasis on dealing with sex trafficking and prostitution.
Freel asked Trembath about the problematic legal language and OnlyFans.
“Wow, this is a good one,” Trembath said.
[Giggles.]
Gamroth had a point, Trembath said, “I actually think that definition (in the ordinance) would be that broad.”
Freel suggested, and Trembath agreed, that language specifying a physical or “in person” presence should be included.
City Manager Carter Napier said Trembath could do more research to determine “what piece of verbiage would be necessary to not criminalize those opportunities for commerce.”
[Giggles.]
Napier recommended putting off the third reading.
Vice Mayor Ray Pacheco proposed postponing the vote until the regular council meeting on Feb. 16.

The Infinite Destinies Annuals featuring the newly bonded folk with the Infinity Stones that have been running through the summer from Marvel Comics, after being delayed for a year by the pandemic, alongside the Black Cat comic book, with Jed MacKay running the show. They tend to have a pattern, a lead character involved in a story that may lead to an individual who wields an Infinity Stone with a Nick Fury back-up strip which has Fury on his own interdimensional journey. Not everything follows that pattern but it creates a general trend. With both Black Cat #9 and Spider-Man: Miles Morales Annual #1 both out today…
Begins with Iron Man fighting on Miles Morales: Spider-Man’s behalf, against The Assessor behind recent assaults on the Morales family, and the teleporting agents he controls called Quantum.
Who it is revealed to have bonded with an Infinity Stone, the source of his power. With Nick Fury setting himself up as defending the Earth from the greatest threats out there.
The Captain America Annual has the Black Widow and Captain America on the Infinity Stones case.
Tracking down Overtime, one of the first to be bonded in the previous big event.

The Amazing Spider-Man Annual saw the most famous bonded individual, Star, look back on her life.
While therapy doesn’t seem to do the trick for her, she takes to murder instead.
While Nick Fury finds himself captured by an interdimensional oddity.
The Thor Annual sees a parallel universe god, Valg, take control in Asgard – a character whose identity was originally hidden.
As the interdimensional oddity taking Fury is revealed as Nighthawk from the Heroes Reborn universe, the only one to remember that life, just as Blade remembered the Marvel Universe in Heroes Reborn. And, just like Blade, wants his reality back.
The Guardians Of The Galaxy Annual has the most bizarre and unbelievable Infinity Stone origin for The Prince Of Power…
… but not as bizarre as The Prince Of Power being totally based on He-Man.
He has the power, you see. While Nighthawk has the power to turn Nick Fury to his own purposes, tracking down Infinity Stones to try and turn reality back again.
But it looks like he installed a back-up in himself for just this eventuality.
Or at least someone did. While today’s Miles Morales: Spider-Man Annual features stone-wielder Amulet, making him the second stone wielder Miles has had close contact with, in recent months.
While Nighthawk and “Falcon” are capturing Star, where Spider-Man failed.
While Nick Fury has his own plan, free of Nighthawk’s control.
Which leads into last month’s Black Cat #8 now with Felicia Hardy discovering the captured body of Star, put on stasis, as Nick Fury does his best to put her off.
Is this kidnapping her or freeing her? Maybe a bit of both?
And Black Cat #9, Felicia wakes Star up. Reveals her play. Such that it is.
And the client has a client.
And to do that, Star’s powers need boosting, and close contact to another Infinity Stone wielder will do that trick.
Which sees both Overtime and Quantum
Pick a stone, any stone… Overtime now, Quantum next month…
The covers tesselate together like this, showing the stones in an Infinity Gauntlet. Four of them do anyway.
While the other three- okay, the Avengers’ connecting cover as currently revealed doesn’t work, but they seem so far to be showing an Infinity knuckle duster…
How long before Thor gets involved again? What if Black Cat’s client is not Doctor Doom? Is Thanos coming to The Black Cat?
After all there was this vision from Black Cat #3 when she was powered up by the Asgardian world tree while fighting The King In Black…
Doom doesn’t look like a client there… not in the traditional sense at least.

In 2018, Zachary Joseph Horwitz, who acts under the name Zach Avery, purchased a $6 million Los Angeles house.
He was then arrested earlier this week and charged with fraud.
The home, which is now marked as for sale with a pending offer, is listed on Zillow as a six bedroom, eight bathroom, 7,670 square foot “reimagined Traditional estate by famed designer Lonni Paul.”
The home boasts a pool and adjoining jacuzzi, cabana with a fireplace, a chef’s kitchen, “a private master suite with custom closets and a spa-like master bath,” and a “chilled 1,000-bottle wine cellar,” according to the Zillow listing.
Photos on Zillow show a living room that opens to a covered outdoor patio; a grand piano below a stunning chandelier and massive abstract piece of artwork; a home theater with ten plush recliners and a sectional; and a home gym worthy of a luxury hotel.
According to his IMDb profile, Horwitz has 15 acting credits to his name. Four of them are for shorts; about half of them for unnamed extras.
Still, after Horwitz bought the house, he also “wired two payments of $70,000 to Lonni Paul Design for retainer/couch/side table,” according to a criminal complaint filed by the U.S. Securities and Exchange Commission on Monday in the United States District Court for the Central District of California.
And a week before Horwitz purchased his beautiful Beverlywood estate, he paid off nearly $300,000 in credit card debt, the complaint said.
Horwitz swiftly paid American Express in three installments: first, he put $70,328.05 toward the card, then $57,351.25, and finally, $164,241.06, the criminal complaint said.
The influx of money, prosecutors said, belonged to investment groups. Horwitz had allegedly told them that their money would multiply risk-free because it would purchase distribution rights to films, which he said he would “license to major online platforms such as Netflix or HBO,” according to the criminal complaint.
Horwitz, 34, is accused of scamming five investor groups, though the bulk of the funds he acquired were from a private firm. He would send fake annual reports to the investors from his fraudulent company, 1inMM Capital, complete with a graphic of a non-existent film library, prosecutors allege.
Some of the money Horwitz made in the alleged $227 million “was used to repay investors for previous investments … consistent with a Ponzi scheme,” according to the affidavit. “In some instances, the investors were repaid with their own money,” the complaint said.
He had to start paying them something, prosecutors said, because in 2019, the investors started to complain.
But when Horwitz was unable to pay investors dividends, he would doctor emails to look like they were from HBO and Netflix executives explaining the delay in funds, the criminal complaint said. Netflix and HBO have denied that their companies engaged in any business with Horwitz or 1inMM Capital, according to the affidavit.
Netflix in February sent a cease and desist letter to Horwitz demanding that he “stop making misrepresentations regarding his agreements with Netflix,” prosecutors said. But he allegedly continued to forge emails to look like they were from Netflix, making excuses to investors about why they had not been repaid.
Federal authorities requested that the criminal complaint be sealed, arguing that since Horwitz has started to sell his house and “not all the proceeds of his fraud scheme have been traced,” he is a flight risk.
But court documents show that a judge Tuesday ordered the case unsealed.
Even though the house is for sale, Horwitz still occupies it, according to the criminal complaint. And Horwitz has not set up mail forwarding, the complaint said.
He is due in court on April 19.
His attorney, Anthony Pacheco, did not respond to repeated requests for comment Wednesday and Thursday.
