U-14 hockey team brings home championship

The Martha’s Vineyard U-14 returned to the Island recently with smiles and a pretty big banner. The team, coached by Brian Donnelly, won the South Coast League Championship.

The team included goalies Holden Brew and Henry Wansiewicz, as well as players Max Metell, Matty MacMillan, Griff Callahan, Will Baliunas, Sol Donnelly, Teddy Pacheco, Wyatt Wiggin, Robby Pacheco, Matthew Fontaine, and Ronan Kelly.

In an email to The Times, Donnelly wrote: “Most of these kids have been skating together since the age of 5 or 6 and had yet to realize a winning season or tournament, but did learn plenty of life lessons along the way. This year the kids really bought into their development and found their strength and confidence. They are friends as well as teammates and they played for each other with heart. It has been a great joy watching these players maturing and becoming fine young men. The team is happy and proud to bring the banner home to our rink where we have spent countless hours training and growing. A true hockey family.”

In a message to parents, Donnelly thanked Adam Wansiewicz, Joe Fontaine, and Erin Pacheco for their help with the team. He also reflected on the team’s performance. “They have been through so much together, from countless hours of practice and games to tournaments in Lake Placid and elsewhere,” he wrote. “Adversity is nothing new to this team as the development path was not necessarily paved with accolades and fair weather. They had to, and did, support each other and remained resilient throughout. It makes their achievements this year so much more sweet!”

Donnelly noted the team effort that went into the championship. “Their poise, compete, effort, and discipline all came together this year,” he wrote. “They worked their butts off to get faster, stronger, better, smarter and it paid off. I am so proud of these kids and their achievement.”

Golden Globes welcome 21 diverse members amid racial exclusion scandal

The Hollywood Foreign Press Association invites its largest class ever — including multiple Black journalists — while confirming changes to inclusion practices, member selection, and bylaws governing conduct.

The Hollywood Foreign Press Association has invited 21 new journalists into its voting ranks amid other sweeping changes the group behind the Golden Globes says it made to bylaws, eligibility requirements, and standards of conduct in the wake of a public scandal over a lack of Black members in the organization.

Representing a 20 percent increase in overall membership, the 2021 HFPA class comprises 48 percent women, with 29 percent identifying as Black, 29 percent as Latinx, 24 percent as Asian, and 19 percent as Middle Eastern and/or North African, the group announced Friday. The move follows a Los Angeles Times investigation that, in February, exposed a lack of diverse perspectives within the HFPA’s then-87-strong membership — notably the inclusion of zero Black journalists in its base.

New HFPA members announced Friday include Raffi Boghosian (Arab News); Kelley Carter (ESPN Global); David Caspi (Israel Hayom); Yong Chavez (ABS-CBN); Andrés Correa Guatarasma (El Universal); Earl Gibson III (Getty Images); Eun Seon Ha (KOFIC); Hamdy Howaida (El Akhbar); Itsuko Hirai (Movie Walker Press); K.J. Matthews (DW-TV); Juan Navarro (Televisa); Jânio Carlos Vieira Nazareth (Cinépop); Ruben Peralta-Rigaud (SensaCine); Gerardo Prat (¡HOLA! TV); Kimberly Reyes (Film Ireland); Mico Saad (TeN TV); Asel Shernivazova (AKIpress News Agency); Gabriel Silva Lamboglia (El País); Miram Spritzer (L’Officiel Brazil); Mario Pacheco Székely (El Universal), and Yuko Yoshikawa (Cinema Today).

The HFPA also brought on an interim chief executive officer in investor Todd Boehly, who has experience as the chairman and CEO of Eldridge Industries — owner of MRC and the Golden Globes production company, Dick Clark Productions.

Each journalist was selected from an applicant pool across the last six months. The association further created a new member committee, a credential committee oversight group filled with both HFPA members and non-member journalists, and revamped its membership guidelines: Invitees no longer need accreditation from the Motion Picture Association, can live anywhere in the United States (past rules mandated residency in Southern California), and can now contribute to radio, online, photography, and broadcast outlets versus just print publications.

“They’re a group of well-respected journalists from around the world who will bring a variety of unique perspectives to this organization,” said Tre’vell Anderson, EW contributor and Beyond the Binary podcast host, who is a member of the association’s credential committee alongside four other non-HFPA members: Terry Anzur, Bel Hernandez, Toni Moston, and Allissa Richardson. “That said, we recognize that this is just a first step in a long process, and as a committee, we’re excited to build upon our work in the weeks, months and years to come to continue creating a more inclusive and supportive collective.”

New HFPA bylaws previously passed in August, with a focus on governance and inclusion that increased seats on its board of directors to 15, created an advisory board to select credentials committee members, and began the search for a chief diversity officer, among other positions. Bylaw changes addressed the group’s conduct, stipulating that members “can no longer accept gifts from studios, publicists, actors, directors,” and others associated with movies and TV shows, and must pay for their own travel to events. HFPA members must sign a code of conduct for anti-harassment and non-discrimination and undergo diversity, equity, and inclusion training. A hotline overseen by a third-party investigatory process was created for reporting breaches.

In May, the HFPA approved changes aimed at cooling months of controversy over its lack of diversity. At the time, the reforms included meeting a minimum addition of 20 new members by August 2021, increasing the HFPA’s membership by 50 percent through 2023 (with a specific focus on welcoming Black members), establishing a diversity, equality, and inclusion strategist, and forming a diverse committee to advise on organizational reform.

Following the L.A. Times report, Ava DuVernay, Regina King, and Kerry Washington addressed the issue on social media, as did the most recent pair of Golden Globes hosts, Tina Fey and Amy Poehler, during the broadcast earlier this year (which notched all-time low viewership ratings on NBC).

Marvel superstars Scarlett Johansson and Mark Ruffalo spoke out against the HFPA’s practices as well, while Tom Cruise gave back his three Golden Globe statuettes in protest. A coalition of 100 publicity firms similarly banded together to demand “profound and lasting change” from the HFPA, and Netflix and Amazon said they would not do business with the group until its problems were resolved.

NBC later confirmed it would not air the Golden Globes in 2022, but would be open to resuming its broadcast in 2023 “assuming the organization executes on its plan” to fix its issues, according to a statement.

Formed in 1943 as a means to distribute Hollywood news to international publications, the HFPA built a reputation for its star-favoring roster of nominees (glittery films like Angelina Jolie’s The Tourist and Cher’s Burlesque scored nominations despite poor critical reception). The issue intensified across the most recent awards season, with many criticizing the HFPA ignoring Michaela Coel’s lauded HBO series I May Destroy You despite recognizing the widely derided (yet commercially successful and, later, Emmy-nominated) Netflix comedy Emily in Paris.

The Times report outlined a 2019 occurrence that saw 30 HFPA members traveling to France to observe production of the Lily Collins-starring series, where they were reportedly treated to a two-night stay at the five-star Peninsula Paris hotel, a news conference, and luncheon at the private Musée des Arts Forains museum. Individuals with knowledge of the situation told EW at the time that “all the rules and guidelines” pertaining to campaign standards were followed, and that the 33 guests arranged travel on their own; the only gift that was given, according to sources, was a notebook.

On a different note, the L.A. Times article detailed concerns over the Globes’ internal processes, noting that they often reject well-credentialed international journalists on top of allegedly accepting perks from entertainment companies, who then reportedly lobbied members for votes. The piece cited an HFPA representative who added that the association doesn’t “control the individual votes of our members,” but seeks “to build cultural understanding through film and TV and recognize how the power of creative storytelling can educate people around the world to issues of race, representation, and orientation.”

Plans for handing out the 2022 Golden Globes have yet to be revealed. The only other time in recent history that the Globes weren’t handed out during a major ceremony came in January 2008, when the HFPA canceled its event in favor of a press conference amid the Writers Guild of America strike.

Did Colorado state lawyers have obligation to report judicial misconduct in judicial department memo?

At least two high-ranking lawyers in the Colorado Attorney General’s Office were aware of the contents of a memo that enumerated allegations of judicial and official misconduct two years before it became public, The Denver Post has learned, but it’s not clear if they ever reported the alleged conduct to authorities or their boss.

The two attorneys – LeeAnn Morrill, a first-assistant attorney general in charge of its public officials unit, and Grant Sullivan, the AG’s assistant solicitor general – were briefed about the memo and its contents by former State Court Administrator Christopher Ryan at a meeting in July 2019 just as he was about to resign, Ryan told The Post.

Law professors who teach professional responsibility say the rules of professional conduct are clear that attorneys should disclose judicial improprieties to authorities when they learn of them, but a requirement to maintain client confidentiality might get in the way.

“In the interest of justice, one ought to report, but it’s not quite that firm of an obligation,” University of Colorado law professor Richard Collins said. “The rule about judicial misconduct is very clear and involves some complex judgment such as what makes a judge unfit for office. If it’s serious enough and part of confidential information they received from a client, then it appears to need their consent to disclose it.”

The memo is central to a $2.5 million five-year judicial training contract awarded in April 2019 to the department’s chief of staff, Mindy Masias, who Ryan said threatened to file a sex-discrimination lawsuit if she were fired over financial irregularities. Masias resigned in March 2019 just weeks before signing the contract, which officially began that June. It was canceled in July 2019 amid a Denver Post investigation into the deal.

The memo detailed more than a dozen instances of misdeeds by judges and other high-level officials within the department that were glossed over or covered up by the agency.

“I provided them the information and chronology that has been relayed” in Denver Post stories, Ryan said of the AG attorneys. “The meeting culminated in me delivering the copy of the memo to (department chief legal counsel Terri) Morrison so she could provide it to Morrill.”

Ryan said he does not believe any action was taken on allegations listed in the memo – allegations that reach to the state’s Court of Appeals and Supreme Court.

“I have no knowledge of any investigation that was undertaken relative to the information in the memo, and after offering to assist in one, I was not asked to provide any further information,” Ryan said, referring to state auditors who later looked into the Masias contract.

The head of the Colorado Judicial Disciplinary Commission, which investigates allegations against jurists and whose findings generally remain secret, would not say whether the body was aware of the memo or its contents, but did say it was keenly interested.

“We are committed to learn more about this either through our own efforts or through the two investigations ordered by the court,” its executive director, William Campbell, told The Post.

Attorney General Phil Weiser on Tuesday said that “Coloradans expect transparency and accountability from public officials entrusted to lead state government. … Independent investigations into the allegations contained in the memo are necessary steps to … instill confidence in the judiciary.”

But Weiser would not say if he was previously aware of the document or its contents.

“The Colorado Rules of Professional Conduct prohibit a lawyer from revealing information or documents related to the representation of that lawyer’s client,” Weiser’s office told The Denver Post in an email Wednesday. “The Attorney General’s Office is required under state law to be the legal counsel to the Judicial Department and the State Auditor, and all state lawyers must follow these rules requiring confidentiality of client information.”

Asked directly whether Weiser knew, his spokesman would not say.

“We cannot confirm or deny any information,” Lawrence Pacheco wrote in an email to The Post.

Former Attorney General Cynthia Coffman told The Post that at the minimum, Weiser should have been told, and that there was a duty to report the alleged misconduct contained in the memo.

“My expectation and policy, as well as the gravity of that memo’s content, would have required them to tell me as the attorney general of Colorado,” Coffman said in a telephone interview. “We are all officers of the court and we take an oath to report all allegations of misconduct. At the minimum, I would have had a conversation with the chief justice” of the Supreme Court.

Colorado’s rules of professional conduct for attorneys requires any lawyer aware of potential judicial misconduct to report it.

“A lawyer who knows that a judge has committed a violation of applicable rules of judicial conduct that raises a substantial question as to the judge’s fitness for office shall inform the appropriate authority,” according to Rule 8.3 of professional conduct.

Another rule, number 1.6, deals with attorneys maintaining the confidentiality of a client and information they learn from them, but could supercede Rule 8.3. The attorney general represents all branches of Colorado government, including the Judicial Department.

Morrill is a 17-year veteran of the AG’s office and for the past eight years and has led the team that counsels and represents Gov. Jared Polis as well as the Judicial Department, the Secretary of State, State Auditor, Department of Local Affairs and the Department of Military and Veterans Affairs.

Sullivan is a 10-year veteran of the AG’s office, all as its assistant solicitor general, and was the appellate law clerk to then-Supreme Court Justice Nathan “Ben” Coats from September 2010 through August 2011. Coats was named chief justice in 2018.

Neither Morrill nor Sullivan responded to Denver Post efforts to reach them.

Ryan has said the memo dates to January 2019 when then-human resources director Eric Brown said Masias was prepared to file a lawsuit baring the department’s secrets.

The Colorado Supreme Court on Monday released the document which it had previously denied Denver Post efforts to obtain under the department’s open records rules. Morrill and Sullivan vigorously defended the department’s withholding the memo.

The unsigned document lists 27 bullet points Brown referred to in a meeting with Ryan, then-Chief Justice Coats and his counsel, attorney Andrew Rottman.

Brown managed to read only part-way through the two-page memo before Coats waved for him to stop and asked what they could do to prevent Masias from following through with the threats, Ryan said.

She was ultimately given a five-year $2.5 million contract to provide judicial training for the whole department. A public bidding process yielded no bids despite dozens of companies requesting information about participating. Several companies previously told The Post that they felt the proposal request by the State Court Administrator’s Office was too narrowly focused to offer a bid.

Supreme Court Chief Justice Brian Boatright said the court is hiring an independent investigator to look into the memo and allegations it was the crux behind the Masias contract. Boatright and the other six sitting justices have denied that the contract was intended to keep the allegations in the memo quiet.

Gov. Jared Polis weighed in, saying he supports the call for an inquiry.

“This memo describes unacceptable behavior within our judicial system, both among members of the bench as well as Judicial employees.  This type of conduct has no place in Colorado,” he said in a statement. “Every person should feel safe in the workplace and every Coloradan should be able to feel confident in the integrity of our judicial system and the high standards to which we hold our judges and our judicial system.”

The memo described a chief justice – it’s unclear which one – ordering the destruction of a note alleging sexual misconduct, the paying of a settlement to a Court of Appeals law clerk to protect a sitting appellate judge’s chances for appointment to the Supreme Court, and the passing of pornographic videos by two judges who would later be named chief judge in their district when no action was taken against them.

Legal associations have also backed the call for investigations.

“We urge the Colorado (Judicial) Department to be fully transparent and to take the necessary steps to redress these issues promptly in order to maintain the public’s faith in the administration of justice in Colorado,” the Colorado Bar Association said in a statement.

All the justices approved of Masias’ contract at the time, but Boatright said they saw the memo for the first time this week. It remains unclear whether Coats told any of them about the memo at the time.
