Walnut Creek to allow recreational cannabis deliveries, but holds off on storefront sales

On the eve of 4/20, the Walnut Creek City Council gave the city’s recreational cannabis users something to celebrate by unanimously voting to legalize delivery of adult-use, non-medical marijuana within city limits.

But there are caveats.

At Tuesday’s meeting — at which a cannabis proponent offered sample joints to the council, to laughter all around — the council capped the number of delivery services that can operate in the city to three. They expect one service to be HerbNJoy, the city’s lone provider of medical marijuana.

On future applications from other prospective cannabis retailers, the city will use a points system to help decide whether to grant use permits. Since HerbNJoy has been a positive contributor to the city’s business community, the council approved an amendment directing staff to process HerbNJoy’s new amended application for non-medical delivery service, giving them already-earned points.

Deliveries will have to be made to a fixed residential address, drivers won’t be able to exceed the state limit of how much product they can carry ($5,000 worth) and must deliver straight to customers without stopping anywhere else.

No decision on storefront sales

The council also decided to push back any decisions regarding storefront sales of cannabis until at least next year.

In 2018, Walnut Creek adopted its own regulations for “personal and commercial cannabis activities.”

City officials said not enough was known about potential impacts to the community if wider use was allowed, and they were also concerned about additional crime and that residents did not want more of a visible presence of cannabis in the city.

The city reassessed its ordinance in 2021 and looked at the impact on 28 other local jurisdictions allowing some form of cannabis sales.

In California, medical cannabis was legalized in 1996 and non-medical use for people 21 and over was legalized in 2016.

A 2021 staff report said 70 percent of cannabis use is recreational and taxable, with the rest being medicinal (which isn’t taxable). Moving away from prescription-only use will increase taxable sales, the report says, and “existing retail stores in Martinez and Antioch are doing extremely well, and in the next eight to 12 months, one new store will open in Pacheco and four to five new retail stores will open in Concord. There is an estimated demand for approximately 10 to 12 more retail stores in Contra Costa County.”

With recreational sales legal in Walnut Creek, the city will collect revenue not only through sales tax, but through business licensing and permit fees.

A Gene Hack Might Save the Wine Industry From Disease-Carrying Bugs

In 1882, there was an epidemic sweeping vineyards in the Los Angeles Basin of California. Named after plant pathologist Newton Pierce, it was known as a mysterious plant disease that turned green leaves brown, shriveled grapes, and killed a grapevine within three years. It would take about a century for scientists to figure out what was causing the disease—a bacteria named Xylella fastidiosa—and who was spreading it: a leaf hopping insect called the glassy-winged sharpshooter.

Despite best efforts to eradicate the half-inch long insect, Pierce’s disease still ravages vineyards today. There’s a fear climate change will exacerbate the problem and make Xyella infections intractable. But there is one glimmer of hope on the horizon—and it involves hacking the glassy-winged sharpshooter’s DNA.

In a new study published May 3 in the journal Nature Scientific Reports, researchers at the University of California Riverside managed to successfully use the gene-editing tool CRISPR to change the eye color of the insect, an alteration that was passed on to its progeny. This may not seem like much, but this proof-of-concept shows that it’s possible to modify the glassy-winged sharpshooter with specific mutations and ensure those mutations stick and aren’t lost to future generations. It means scientists might have the perfect tool to end the insect’s bacteria-spreading reign of terror and save countless vulnerable vineyards from infection.

“Our team established, for the first time, genetic approaches to controlling glassy-winged sharpshooters,” Peter Atkinson, an entomologist at UC Riverside and the study’s co-author, said in a press release.

Since 2014, scientists have been using CRISPR—a technology developed from bacteria that allows precise edits to specific genetic sequences—to eradicate diseases like malaria and control pests.

“This is a great technology because it can be so specific to one insect, and not cause off-target effects on other insects, animals or humans,” Inaiara de Souza Pacheco, an entomologist at UC Riverside and lead study author, said in the press release. “It’s a much more environmentally friendly strategy for insect control than using chemicals.”

Using CRISPR, the researchers were able to modify the genes that control the sharpshooter’s eye color, changing it from brown to white or cinnabar. They discovered that these genes are not passed down based on gender, like if white eyes were only passed down to only males or females. Instead, nearly 100 percent of the insect eggs modified by CRISPR gave rise to insects with different eye colors, and better yet, these new traits were passed down three or more generations.

“It’s absolutely amazing because the success rate in other organisms is often 30 percent or lower,” Linda Walling, a plant biologist at UC Riverside and study co-author, said in the press release. “The high rate of gene editing success in glassy-winged sharpshooters bodes well for our ability to develop new methods of insect control, as well as understanding the basic biology of this devastating pest.”

This success means the researchers are ready to home in on their real target: the glassy-winged sharpshooter’s mouth. That’s how the X. fastidiosa bacteria is typically spread.

“We’re using CRISPR to try and modify the mouth parts of the sharpshooter so they can’t pick up the bacteria that causes Pierce’s Disease,” Rick Redak, an entomologist at UC Riverside and study co-author, said in the press release.

If this proves successful, not only will CRISPR be saving California’s $58 billion wine industry by saving grapevines from an early death, it could also become a popular approach to controlling bothersome insect populations that ravage agricultural crops and spread destructive diseases.

“It’s looking like sharpshooters will become a model organism for the Hemiptera, this big category of piercing, sucking insects,” said Redak. “Our model of using CRISPR for them could blow open our ability to control diseases they transmit to plants and possibly, to humans as well.”

Genias in Music: La Lupe (A Latino USA Podcast)

Rainbow García stood on her old block in the Bronx, New York with bouquets of yellow roses and balloons. It was a few weeks after the 30th anniversary of her mother’s death, and Rainbow was making an ofrenda right on the street that’s named after her mother—La Lupe Way. Rainbow is the daughter of Lupe Victoria Yolí Raymond, or La Lupe— an Afro-Cuban singer who was once called the “Queen of Latin Soul.”

When Rainbow was growing up, La Lupe drove a station wagon and had a pet German Shepherd that would escort her down the block. But Rainbow said that even though her mother “wanted to be normal, she honestly stood out,” because she wasn’t just any neighbor: She was La Lupe, an inimitable artist whose performance style shocked audiences in the 1960s and 1970s. Rainbow said this part of the Bronx is a legend like her mother.

This episode of Latino USA is part of our series Genias in Music, remembering notable women and their contributions to their fields throughout history. In this installment, we question some of the myths about La Lupe that attempted to delegitimize her music and we look at how her identity as an Afro-Latina influenced the racist and sexist characterizations of her as “possessed,” “crazy” and “on drugs.” Scholars like Jadele McPherson and biographer Juan Moreno-Velázquez argue that La Lupe was misunderstood while she was alive because there was no one performing like her in the American and Latin mainstream. By singing and moving in the ways she was known for, La Lupe was resisting her erasure and claiming her space—whether audiences understood it or not.

La Lupe’s album covers portrayed her in metallic over-the-knee boots, mink coats, and petaled white skirts. She played at Carnegie Hall, headlined at Madison Square Garden and starred on Broadway. But before La Lupe became a legendary figure in New York, she was one of the top performers in Havana, Cuba in the late 1950s and early 60s, amid the Cuban Revolution. She was born in Santiago, on the eastern side of the island, which has one of the oldest comparsa or carnival traditions in Latin America.

La Lupe’s scream-like vocals and frenetic movements made her performances unpredictable—and unforgettable. Accounts of La Lupe’s act became like folklore in Cuba; onstage, she would moan, groan, shriek, kick off her shoes and pull her hair. As her radical stage persona became mythologized in Cuba, she threatened another revolutionary figure: Fidel Castro. By her account, Castro sent his officers to tell her that he wouldn’t share the spotlight. He censored her art, so La Lupe knew she had to leave the country.

When La Lupe arrived in New York City in the early 60s, she recorded with some of the biggest names in the Latin music scene, including percussionist Mongo Santamaría, with whom she recorded her first album in exile. She also met Tito Puente and they became friends and collaborators, recording multiple hits and albums, including the bolero “Qué Te Pedí.”

With artists like Puente, Santamaría and Johnny Pacheco, La Lupe was one of the only women performers helping solidify a Caribbean diasporic style in New York. And while she was known for boleros and boogaloo, she was also inspired by American genres like soul and rock, singing in both English and Spanish—often within the same song.

La Lupe was called “The Queen of Latin Soul,” both to promote her as a crossover artist, but also because she made soul music her own.

“She started to create musical arrangements that you could say are polyrhythmic and she’s putting them into sounds that you hear in R&B and pop music and soul music,” said Jadele McPherson, an artist-scholar who has studied performance and religion in Santiago de Cuba.

By the mid-70s, La Lupe’s label Tico Records was acquired by Fania, the “Motown of salsa.” With the salsa movement underway, Fania wasn’t as interested in La Lupe’s style and she was brushed aside while Celia Cruz was elevated. La Lupe earned the reputation of being difficult to manage and there were rumors that she was a drug abuser, even though her family and friends have consistently denied these claims. Changing tastes in Latin music coupled with her strained reputation led her career to decline by the 80s.

To her fans and Bronx community, La Lupe is an identity. Her pioneering legacy remains present through her music and memory, passed down to young generations of Latinos and Latinas who heard their families belt Lupe’s lyrics at barbecues and in their tías’ living rooms.
