U.S. Supreme Court to Hear Colorado Case Pitting Speech Rights Against Minority Groups’ Rights – Tennessee Star

The U.S. Supreme Court will hear oral arguments starting next week in what could be a landmark case centered on a Colorado small business owner’s free speech rights.

Lorie Smith, owner of graphic design company 303 Creative in Littleton, Colo., is challenging the state’s public-accommodation law, which she argues is compelling her speech. Smith wishes to create wedding websites only for straight couples, citing her religious beliefs.

Colorado argues this would violate the state’s public-accommodation law, which prevents sales discrimination but does not regulate speech.

The case also mirrors another high-profile case from Colorado that worked its way up to the Supreme Court but ended with a narrow ruling. In Masterpiece Cakeshop v. Colorado Civil Rights Commission, the court determined that the commission discriminated against the shop’s owner, Jack Phillips, who refused to make a cake for a same-sex marriage wedding but did not address free speech rights.

Smith says Colorado’s law compels her speech as an artist to create messages that go against her traditional beliefs on marriage.

State law reads in part: “It is a discriminatory practice and unlawful for a person, directly or indirectly, to refuse, withhold from, or deny to an individual or a group, because of disability, race, creed, color, sex, sexual orientation, gender identity, gender expression, marital status … the full and equal enjoyment of the goods, services, facilities, privileges, advantages, or accommodations of a place of public accommodation…”

According to Smith, the artwork she creates with her business is custom, “but Colorado is … compelling my speech and forcing me to use my artwork to design and create and celebrate messages that violate my beliefs.”

The Colorado attorney general’s office says giving Smith an exemption from state law would pave the way for businesses to discriminate against prospective customers.

“The nation and the state of Colorado have long required businesses open to the public to serve all customers. The U.S. Supreme Court has repeatedly affirmed the state’s ability to prevent sales discrimination,” Lawrence Pacheco, the office’s communications director, told The Center Square. “Abandoning this important and longstanding principle now would allow businesses to discriminate based on who customers are, including on the basis of gender, race, and religion. The Court should protect these important civil rights.”

Smith’s attorney with Alliance Defending Freedom, the conservative law firm that also represented Phillips in his case, argues a ruling in Smith’s favor would mean LGBT graphic designers wouldn’t be forced to create websites against their beliefs, such as one criticizing same-sex marriage.

“A ruling in Lorie’s case would protect the LGBT graphic designer who doesn’t want to be forced to criticize same sex marriage just as much as it would protect Lorie,” ADF attorney Kellie Fiedorek said.

The Colorado attorney general’s office maintains the state’s anti-discrimination law “regulates sales, not speech.”

“What a business chooses to sell to the public remains entirely up to the business,” Pacheco added. “Therefore, a public business that designs and offers LGBTQ-themed websites must offer those LGBTQ-themed websites to all customers, even if those customers are opposed to same-sex marriage because of their religion.”

The case, 303 Creative LLC v. Elenis, has drawn dozens of amicus briefs on both sides of the issue.

Rob Natelson, a senior fellow in constitutional jurisprudence with the Denver-based Independence Institute, told The Center Square that it will be interesting to see if the court goes the route of the U.S. Constitution’s original meaning or balancing.

“In the 303 Creative case the Court of Appeals said [Lorie] has a free speech right in making websites but the state has a compelling interest in protecting marginalized groups, and the law is narrowly drafted to promote that interest, and therefore her right is outweighed,” he told The Center Square.

“Now that doesn’t really work very well with the First Amendment,” Natelson added. “The First Amendment says the right to free speech shall not be infringed, right?

“I think she will win because the implications of allowing the state to force her to say things are really grave and, from a constitutional standpoint, the real interesting question is whether they use this 20th Century methodology that’s really divorced from the real meaning of the constitution, or whether they do what they did in the New York State Rifle Association case and go back to the original meaning of the constitution and decide it on that ground.”

Smith described in an interview the 6-year-old case as a “rollercoaster ride” – from lower courts siding with the state to being harassed, doxxed, and even facing death threats.

“I think the hardest part for me is that those who oppose my view on marriage may not really understand that what I’m standing to protect – the right to speak freely protects all of us,” she said. “Not only does it protect me but it protects the LGBT web designer who shouldn’t be forced to promote messages opposing same-sex marriages.”

Smith and her attorney are hopeful the Supreme Court will rule in her favor.

“The Constitution is very clear that the government cannot compel speech, it cannot compel expression,” Fiedorek said. “Every single one of the justices has taken an oath to uphold that Constitution, so we’re very hopeful that they will rule in favor of free speech and not force artists to say something they don’t want to.”

Oral arguments in the case are scheduled for Monday, Dec. 5.

Welcome, friends, to a tour that — once we’re done — will have changed your entire outlook on the world’s prison system. Usually, we associate prisoners with hardened criminals, strict guards, harsh rules and regulations, and little to freedom. In places like Alcatraz, armed guards patrolled the corridors, equipped with tear gas dispensers and supported by remote-controlled machine weaponry — trying to leave your cell meant risking your life.

But in places like Bastoy Prison in Norway, you’d be forgiven for thinking you were ever locked up in the first place.

Behind the entrance to Bastoy Prison you’ll find high-class amenities, usable bikes, TVs, and (we’re not kidding here:) tanning beds. Seriously, this place gives 5-star hotels a run for their money. But Bastoy isn’t the only jail we’ll see today — with exclusive access finally granted, join us as we head to places like Spain, Germany, and Switzerland to explore a handful of the most luxurious prisons on the face of the Earth.

In places like Aranjuez in Spain, parents are allowed to bring their kids, all for the betterment of families staying together. The cells are lined with cribs, Disney characters on the walls, and a dedicated kids’ play area. Ready to check these “prisons” out? Let’s do it!

Fourteen Acres’ bounty – Vegetable Growers News

In an unusual combination, central Texas distillery Tito’s is growing fresh produce, and seeks to inspire other distilleries to do the same.

Tito’s, Austin, Texas, officially introduced Fourteen Acres Farm in August to ensure its employees have fresh and healthy food and to encourage healthy eating. Up until then, Fourteen Acres was operating behind the scenes, growing on 74 raised beds and 16 high tunnels.

Seven farmers cultivate more than 30 items at the farm, including artichokes, broccoli, Napa and red cabbage, carrots, cucumbers, eggplant, mixed baby greens, kale, kohlrabi, romaine, spinach and sugar snap peas.

Originally, employees received fresh fruits and vegetables through a company farm share program. Fourteen Acres now serves as a weekly farmers market, where they can select their produce and connect with farmers to learn recipes, cooking tips and how the food is grown.

Worms to the rescue
In 2021, Fourteen Acres added vermiculture – the use of worms to decompose organic food waste into nutrients. That fall, the farm began making bio-complete compost, started an in-house soil lab and began conducting crop trials with more fruit, beginning with strawberries.

“The addition of vermiculture is incredibly important, as it heavily influences nutrient cycling and increases resistance to pests, diseases and pathogens,” said Kathleen Kuper, farm director. “It also assists with better root growth and nutrient absorption. Additionally, the liquid amendments help with foliar feeding and support pest and fungus control.”

Soil health remains critical for Fourteen Acres.

“Soil health is important because, like the popular saying goes, ‘You are what you eat,’ and that holds true for plants, too,” Kuper said. “The healthier our soil is, the better yield we’ll see with our crops. By establishing an in-house soil lab, we’ll know how to best balance our soil to make it as healthy as possible, improving our ability to grow. Conducting crop trials allows us to be better farmers and produce better crops for our employees to enjoy.”

Crimson clover, millet and sorghum are some of the cover crops Fourteen Acres plants to help plant growth by preventing soil and wind erosion. The cover crops also help improve soil and feed the microbiome. Blooming cover crops feed bees and encourage pollination of the crops, which also include yellow and Zephyr summer squash, butternut, acorn, spaghetti, kabocha and tetsukabuto winter squash.

Because it manufactures its own inputs, Fourteen Acres remarkably hasn’t experienced major difficulties acquiring herbicides, fertilizers, insecticides and fungicides.

“Because we’re a sustainable farm, we can easily make and acquire what we need,” Kuper said.

Tunnel protection
Challenges remain, however.

“The biggest challenges we face in growing are the wind, soil and water, as well as pests, disease and weather,” she said. “In recent years, Fourteen Acres worked to cultivate the soil and developed a rainwater collection system.”

“The high tunnels help with crop production by extending our growing season, as well as protecting our crops from the wind and flooding,” Kuper said.

Additionally, shade cloths on the high tunnels provide sun protection.

Fourteen Acres uses a regenerative farming philosophy.

“Stewardship and sustainability are core to our regenerative farming philosophy, through which we focus on giving back to the earth as we take from it,” Kuper said. “We want Fourteen Acres Farm to be long-lasting, so taking care of and regenerating our soil, land and water gives longevity to the farm.”

Other items grown at the farm include heirloom, cherry, slicers and green tomatoes, a variety of peppers, melons and potatoes. Fourteen Acres sources avocados, mangoes, grapefruit and oranges from nearby organic farms.

Part of community support is Tito’s Love, Tito’s Block to Block, a national program. Inspired by Fourteen Acres’ success in supplying its workers fresh produce, the program works with nonprofits to identify gardens, farms and growing spaces that could benefit from Tito’s’ financial and physical support.

The program distributed more than 200 fruit-bearing trees to community members and organizations in Oklahoma City and provided seedlings, fertilizer and educational materials to more than 90 community gardens in Houston.

In addition to improving community gardens and farms in Los Angeles, Phoenix, Arizona, Detroit, Michigan, Portland, Oregon, and Richmond, Virginia, Tito’s plans to construct growing spaces in New York City, Denver, Indianapolis, Salt Lake City and in other U.S. cities. In Kansas City, Missouri, the program revitalized a community garden by constructing more than 40 raised beds, which increased the ability of community gardeners to grow produce for their families.

“We wanted to take what we learned in our own backyard and use that to give back to our communities all across the country, increasing access to fresh, healthy foods, and bringing people together – one block at a time,” Kuper said.

Is El Salvador preparing to reverse its landmark mining ban?

  • El Salvador banned all mining of metals in 2017, but environmentalists are concerned that the government is preparing to reverse the decision and bring in international investment.
  • The government has created a new agency to oversee extractive industries and begun looking into international agreements that facilitate investment in precious metals.
  • Five “water defenders,” who have spent decades speaking out contamination of water sources by mining projects, were arrested in January after mining officials visited their town of Santa Marta.

MEXICO CITY — It was considered a major environmental victory, back in 2017, when El Salvador’s government announced it would be the first country in the world to issue a total ban on metal mining. For a half-century, the industry had been dumping waste and toxic chemicals into local rivers. Prioritizing clean drinking water was a must as climate change worsened droughts in the region.

But the government today appears to be on the verge of turning back a page. President Nayib Bukele, a populist who’s made investment and infrastructure the centerpiece of his agenda, has taken a number of steps that, at least on the surface, look like preparations for a return to mining. His government has established a new agency to oversee extractive industries and started looking into international agreements that would facilitate investment in precious metals.

It also arrested several anti-mining activists on what critics say are dubious charges. Five “water defenders,” who led the charge on the 2017 mining ban — and who had begun to speak out again last year — were arrested this past January for their alleged involvement in a kidnapping and murder that took place during the country’s civil war 30 years ago.

It’s unclear how legitimate the accusations are. The water defenders were part of a resistance group fighting the right-wing dictatorship during the war. But they come from Santa Marta, a community founded by displaced people largely considered to be victims. “The arrests are politically motivated as they seek to silence these water defenders and to demobilize community opposition at this critical moment,” the Institute for Policy Studies, a progressive think tank that also advocated for the mining ban, said in a statement.

The water defenders started speaking out against industrial mining around 2005, when the rising price of gold attracted increased interest in the untapped deposits across northern El Salvador. Specifically, the water defenders were concerned about mining around the Lempa River Basin, which is one of the principal water sources in the country. It would take more than a decade and several lawsuits before the country finally banned the industry.

One of those arrested, Antonio Pacheco, is the director of the Association of Economic and Social Development (ADES), one of many organizations in northern El Salvador trying to draw attention to water contamination problems left over from before the 2017 ban. His organization was also trying to raise awareness of the rise in artisanal mining, which allegedly relies on child labor and mercury.

There are other signs that mining could be on its way back. A government agency to regulate the energy and mining industries, called the General Directorate of Energy, Hydrocarbons and Mines, was created with congressional approval in October 2021. And later that year, the country joined the Intergovernmental Forum on Mining, Minerals, Metals and Sustainable Development, an international body that supports “sustainable development goals” for the mining sector. Neither institution responded to a request for comment.

The country last November also began negotiating a trade deal with China that some environmentalists fear will include pathways to introducing mining concessions. China has made an aggressive push into Latin America in the past few years with its Belt and Road Initiative, an international investment program to develop infrastructure, energy and mining projects. El Salvador joined in 2019.

“We call on the international community to join in the Salvadoran people’s fight to protect water, defend the environment and secure the right to life that is gravely threatened by the harmful mining of metals,” said 20 local environmental and public health groups in a statement last month.

Bukele has a track record of launching controversial projects that ignore environmental concerns in the name of economic growth. A new airport and train line meant to bring international commerce to the eastern half of the country circumvented some preliminary environmental regulations and could threaten mangrove ecosystems. A number of highway projects are also raising concerns about deforestation.

A more unorthodox bet on economic growth was making bitcoin a legal tender alongside the U.S. dollar. The cryptocurrency crashed last year, and there was concern from international observers that the country would default on an $800 million bond in January. If the country needs capital, as well as economic stability, opening up a lucrative mining sector could be an option, observers said.

“It seems like the only way out that this government sees is to bet on investment,” said Vidalina Morales, president of ADES. “To bring investors to the country to do what’s most feasible: mining.”
