Martinez refinery: Toxicologists to determine if residents were poisoned by tons of chemical dust – Red Bluff Daily News

Tens of thousands of people living in and around the Martinez Refinery Company still don’t know for certain if — or to what extent — they were poisoned last November.

But five months after 24 tons of toxic, dusty residue from gasoline, diesel and jet fuel flowing through the refinery first showered down on its next-door neighbors, new soil samples collected this week may finally confirm what dangers still linger there by late May or early June, county health officials announced Thursday.

Last Thanksgiving, the company posted on Facebook that the fine white substance that blanketed cars, porches and plants over the holiday was from a “non-toxic”, “non-hazardous” and “naturally occurring” catalyst dust expelled from its facility on the edge of town.

But within a few days, the Contra Costa County Health Department alerted residents that the ashy grit actually contained aluminum, barium, chromium and other hazardous metals — chemicals that are linked to nausea, vomiting, respiratory issues, immune system dysfunction, cancer and even death.

People living nearby were told in March to discard any food grown in gardens and fruit trees, just to be safe.

On Thursday, TRC, a Concord-based environmental consulting firm, started collecting soil samples from 14 different sites neighboring the refinery, which is located at 3485 Pacheco Blvd. Toxicologists will now evaluate the extent of contamination that residents were exposed to through skin contact, inhalation or consumption of food grown in the ground, according to Laura Trozzolo, a senior human health risk assessor with TRC.

She said the soil sample locations were chosen based on a map of where the plume of particles likely landed, using models from the Bay Area Air Quality Management District created using residents’ observations and wind simulations.

Trozzolo said that neither the five-month delay in data collection — due to the county’s lengthy contracting procedures — nor the recent historic storms that drenched the area should negatively impact lab findings.

“If we’ve had any deposition that might have landed on the surface over time, we’re still going to be capturing that within that top six-inch soil layer,” Trozzolo said during a press conference Thursday afternoon. “We do believe that we’re still characterizing and capturing conditions that occurred during that November event.”

Nicole Heath, director of the county’s hazardous materials program, said a 1990s-era industrial safety ordinance allows them to initiate an independent investigation and community risk assessment any time there’s a “major chemical accident or release,” such as the Martinez Refinery Co. event.

She said that ordinance allows the county to form an oversight committee, which brings together elected officials, county staff and community members with representatives from the refinery and its labor force.

“An independent incident investigation will look at root cause analyses, which would then determine exactly what happened, why it happened and what can we do to prevent things like this from happening again,” Heath said, later adding that similar chemical releases happened twice before at the refinery in the early 2000s, which was owned by Shell at the time. “We’re responsible, as the oversight committee, for holding the facility accountable.”

Business |

Kaufmann said that while the health department can invoice the refinery to reimburse expenses during their investigation, the DA will be in charge of deciding whether or not the Martinez Refining Company should be responsible for financially compensating residents who lost food and soil.

Physical remediation efforts are also stalled until the upcoming lab results are complete, Heath said.

In the meantime, the county is still recommending that residents impacted by the toxic dust avoid eating any produce planted in the soil. However, gardeners are also encouraged to plant new seeds, in the event that soil samples don’t uncover any hazards.

“We are waiting to have the information from the soil sampling and risk assessment from TRC so that we can provide the answers that we know the community is so desperately, desperately seeking,” Heath said. “These corrective actions are in such a nature that they are intended to prevent something similar from happening again.”

From building sites to restaurants: Andalucía’s new battlegrounds against climate change | Sur in English

Héctor Barbotta

Already common practice, but as of this week it is law. Diners now have the right to take home any uneaten food in biodegradable containers provided free of charge by any restaurant. This is one of the measures included in the Circular Economy Law, approved on 22 March in Andalucía’s Parliament and in force as of 1 May.

The ruling, approved with votes in favour from PP and PSOE, (against: Vox; abstentions: Por Andalucía and Adelante Andalucía), aims to change the public mindset of what our economy should be: instead of make-use-bin, we should embrace a circular economy attitude of make-use-salvage-recycle-reuse.

The regional minister for Sustainability, Ramón Fernández-Pacheco, pointed out that this is the first such law to come into force in Spain, demonstrating an awareness of how exposed Andalucía is to the consequences of climate change. He also stressed the importance of reaping the benefits of better recycling of grey water and reducing water consumption in the first place.

What is the circular economy?

Reduce waste to the minimum

(This new law in Andalucía is aiming for 10%)

All materials stay in use as long as possible thanks to recycling and reuse.

Create more efficient and sustainable products, as well as reduce energy consumption and resources.

Farewell to the concept of “use it, bin it”

This entails sharing, renting out, reusing, repairing, renovating and recycling existing materials and products as many times as possible to create added value. Thus the product lifecycle is greatly extended.

that requires large amounts of cheap, readily available materials and energy.

The objective of this ruling, applicable to all manufacturing sectors, is for waste to become products, thus reducing its polluting impact on the environment and curbing climate change. This is no pie-in-the-sky goal – it aspires to reduce waste going to landfill to 10 per cent of the total produced.

To reach this target, this new law promotes efficient use of resources, extending the useful life of products, minimising waste generation and combating all types of obsolescence, in particular banning planned obsolescence and the destruction of unsold, durable goods.

Likewise, it provides tax discounts: for companies that refurbish or repair products; for any in food distribution or catering that can prove reductions in food waste; for those in the prevention and collection of ocean waste, plus any companies, private homeowners, neighbourhood communities or other users that sign up to composting and other biowaste treatments.

Greener public procurement

Putting its own house in order first, now the statute is active, the regional government’s administration is obliged to include the required minimum criteria and objectives in the regulations for each industry sector regarding greener procurement processes. Thus bidders must be able to prove their calculations of greenhouse gas emissions for their production processes.

The law also limits single-use products by all public entities, except for hygiene reasons.

Similarly, it favours reductions in the production of food waste and the purchasing of fresh, or seasonal, products, or those with a short distribution cycle in contracts related to all hospitality services, as well as in food supply contracts, especially in educational, social welfare and healthcare centres. For the tendering process, agreements established with community or charitable organisations for the donation of surpluses gain extra credit.

Priority will be afforded to those production or service processes operated by renewable energy sources, or by the use of textile garments made with recycled materials and via other sustainable manufacturing processes.

Likewise, new homes and public buildings must abide by tougher criteria in economies of use of water, reduced energy consumption, guaranteed heating/cooling comforts and just all-round green efficiency.

In tendering for public works, this law adds weight to those bidders who reduce waste generation during construction or once in operation. Also to those using recycled building materials and waste, or those supporting environmental restoration and the salvaging of rundown spaces, and those who save on the use of natural resources by using materials from sustainable sources or, again, from waste.

The building trade is one of the sectors most affected by this new law, bringing in structural changes. The details in the ruling outline the principles, criteria and tools for a circular economy in the sector, from the design phase to waste management originating from both public and private works.

Besides the aforementioned requirements for new homes, new developments must lay down water-absorbent paving alongside resources for the recovery and reuse of rainwater and the installation of storm-water detention tanks.

The goal here is to increase the use of recycled and recyclable materials. To this end, measures are included to reduce the production of building waste and to improve its removal. One initiative is that builders pay a guarantee, at municipal level, when obtaining the building permits. The guarantee is refunded once it has been certified that the rubble has been dealt with by an authorised body, thus eliminating the illegal dumping of rubble in roadside ditches and beauty spots.

The law also sets out the penalties for breaking the rules: fines of 30,000-120,000€; temporary shutdowns between three and five years; disqualifications from carrying out the business activity between one and five years, plus emergency sanctions where needed. These are the administrative sanctions that can only be applied if a criminal case is not already open.

Food waste

Another objective of the new law is to reduce food waste, from creation to consumption, in homes and restaurants. Hence the law requires food establishments to provide, free of charge, only at the customer’s behest, a biodegradable container with any uneaten food they have bought.

Town halls are also authorised to set out bonuses for businesses that work with food banks or similar organisations.

Added to this are the voluntary agreements that promote composting and specific measures to develop bio-industries (as in biodegradable plastics, wood pulp…).

The new law obliges the Junta de Andalucía to generate a more circular attitude towards water management through a fiscal policy that aims to have all the region’s key water sources in good condition and adequately protected.

By 31 December, 2025, at the latest, a minimum of 65% by weight of all packaging waste from products brought to market should be recycled. In the case of single-use plastics, the targets are 77% by 2025, 90% by 2030. The Junta and town halls must deploy the necessary measures to guarantee a separate collection service of single-use plastics for recycling.

Electronic goods

In addition to discouraging throwing away products before we need to, the law requires companies and other public and private bodies to create a more circular economy for electrical and electronic goods to combat the digital divide.

These entities can provide funds for electronic goods that still have a useful life to be refurbished and delivered, free of charge, to educational and community groups and families with fewer resources.

Importing waste

The image of ships reaching Andalucía’s shores filled with hazardous waste to dump in Nerva (mining area in Huelva with a controversial landfill site) or other regional landfill sites will become history thanks to this law. Previously this was not set in stone, so hazardous waste and contaminated soils were transported in from other regions.

A key principle of the circular economy is self-sufficiency within a defined territory. Thus, in general, the entry of hazardous waste and stable, non-reactive, hazardous waste or treated waste from outside Andalucía is now banned.

Pharr Mayor Ambrosio Hernandez wins reelection for third term

PHARR — The city of Pharr has decided on another four years of Ambrosio Hernandez.

Hernandez defeated former Pharr Chief of Police and City Manager Andy Harvey and Ricardo “Rick” Pedraza during Saturday’s May 6 local entities election.

Hernandez arrived at his victory party at Smokin’ Moon BBQ Saturday evening, and he was immediately greeted with applause and chants of “Four more years!”

Speaking amid the celebrations, Hernandez said that he was excited to have another four years in office and expressed gratitude to his supporters.

“I’m feeling great,” Hernandez said. “I’m really delighted, excited, full of emotions, all positive feelings.”

The mayor said that he was hopeful that Pharr residents would give him a third term in office and the opportunity to live up to his campaign slogan of moving Pharr forward.

“I have put forward a platform with my team, that we are indeed your team for the city of Pharr to move the bar forward, and to continue on our legacy to keep Pharr as a complete city moving in the right direction,” Hernandez said. “I am so honored to be awarded that trust by them, and I will not let them down again.”

Hernandez garnered 1,876 votes for 63.9% of the vote to Harvey, who received 943 votes cast for him for 32.15% of the vote.

Pedraza, meanwhile, received 114 votes for 3.89%.

Hernandez has served as mayor for the city of Pharr since 2015.

Harvey served as Chief of Police for the city of Pharr from July 13, 2020, to Sep. 12, 2023.

During that time, he also held a brief stint as the Pharr’s city manager April 22, 2022, to Sep. 6, 2023, when he announced his resignation at a regularly called meeting of the board of commissioners.

The race for Place 1 on the city commissioner has incumbent Eleazar Guajardo going up against Edgar Rincon and Michael Pacheco.

Pacheco unseated Guajardo with 1,474 votes for 50.74% of the vote. Guajardo had 813 ballots cast for him for 27.99% of the vote. Rincon, meanwhile, garnered 21.27% of the vote with 618 ballots cast in his name.

Place 5 Commissioner Ricardo Medina and Place 6 Commissioner Itza Flores ran unopposed.

David Morrell Jr Faces Yamaguchi Falcao On Gervonta Davis Vs. Ryan Garcia Card On April 22nd – Boxing News 24

By Matt Lieberman: David Morrell Jr will defend his WBA ‘regular’ super middleweight title against 2012 Olympic bronze medalist Yamaguchi Falcao in a twelve-round co-feature about next week on the Geervontaa ‘Tank’ Davis vs. Ryan Garcia card.

Placing Morrell-Falcao in the chief support bout isn’t likely to move the needle to motivate boxing fans sitting on the fence, deciding whether to pull the trigger to purchase the $84.99 event on Showtime pay-per-view on April 22nd from the T-Mobile Arena in Las Vegas.

Morrell (8-0, 7 KOs) had been scheduled to face fringe contender Sena Agbeko, but the Nevada State Athletic Commission didn’t license him.

“Although I have a new opponent, the mission is still the same: seek and destroy,” said Morrell Jr. “I’ve been fighting my whole life. I’ve seen every style, and I’m prepared to face anyone that’s in front of me. It’s go time, as usual. Don’t miss this fight!”

It’s too bad a better opponent couldn’t have been found for Morrell to fight because this isn’t a big enough match-up to excite the fans. Diego Pacheco, Demetrius Andrade, Vladimir Shishkin, or Edgar Berlanga would be better options than the 35-year-old Falcao.

“They call me ‘The Problem,’ and I am coming to show the world that I have the talent and determination to become the WBA Super Middleweight Champion,” said Falcao. “I promise that everyone tuning in will be extremely happy with the show that we put on. I’m coming to win on April 22.”

The bad news for fans is that the 35-year-old Falcao (24-1-1, 10 KOs) isn’t any better than Agbeko and might be a worse opponent. Falcao is a classic example of a decent amateur, but his ability didn’t transfer to the pros. Now long in the tooth in his mid-30s, Falcao will look like a fish out of water against Morrell, and the fans will witness a non-competitive slaughter.

If the main event delivers between Gervonta and Ryan, fans will feel they got their money’s worth paying $85 on PPV. Still, if it doesn’t, the chief support bout won’t give them much entertainment, nor the rematch between 37-year-old journeyman Gabe Rosado and Bektemir Melikuziev.

Although Falcao was a good amateur, he’s not been impressive in the pro ranks during his nine-year professional career. This is not likely to be a competitive fight, with him taking on the talented 25-year-old Cuban Morrell.

Falcao’s only career defeat came against Christopher Pearson by a 10-round unanimous decision in 2019. For those unfamiliar with Pearson, he’s a guy that Justin DeLoach and Carlos Gongora knocked out.

Falcao also had a 10-round draw against D’Mitrius Ballard in 2019. Ballard is the guy Jaime Munguia knocked out in three rounds last year.

The fact that Falcao wouldn’t beat Ballard or Pearson gives you a pretty good indication of what kind of co-feature bout fans will likely be seeing on the Tank Davis vs. Ryan Garcia card next week on April 22nd.

Angellyh Yambo Art & Design Room Unveiled as Former School Honors Gifted Teen

THE ART ROOM at Concourse Village Elementary School in the South Bronx was officially renamed The Angellyh Yambo Art & Design Room during a ceremony on March 30, 2023, in honor of the elementary school’s former student, Angellyh Yambo, a gifted artist who was fatally shot near her high school in Mott Haven on April 8, 2022.

Concourse Village Elementary School held a memorial ceremony for former student Angellyh Yambo on March 30 during which the school’s art room, a place she loved to hang out, was dedicated to her. The former student, who spent much of her youth in Kingsbridge Heights, was tragically killed in broad daylight as she walked home from school with friends in Mott Haven on April 8, 2022. She was hit by a stray bullet shot by a then 17-year-old male youth.

The private ceremony, which her family and friends attended, was held to honor and memorialize Angellyh who, according to those present, had developed a close bond with the school community, one which continued even well after she graduated. The ceremony was emotional for all involved as Angellyh’s family and former teachers shared their favorite memories of her.

The school’s principal, Dr. Alexa Sorden said, “Being able to create something that honors her that is so beautiful and highlights her [artistic] talent was very important to us as a community because she will forever continue to live in our hearts and our lives.”

A slideshow of photos and videos of Angellyh during her time as a student at the school, all the way up to her graduation, was shown during the moving event. Meanwhile, the art room was decorated in pink, Angellyh’s favorite color, and was filled with more photographs of her. Sorden continued “So today’s purpose is in honoring her, honoring her family, her friends, and all of us that love her and making sure that she continues to live on.”

Yanely Henriquez, Angellyh’s mom, gifted the school a personalized glass engraving from both her and The Angellyh Yambo Foundation, which read “Thank you Concourse Village, Thank you for your love, Thank you for being there, You guys rock.” Addressing those gathered, Henriquez tried to hold back her tears as she said, “Thank you is a very small word so what I really want to express is everything that you all have done for being there. This room that you’re doing for my girl, this is beyond expected.”

The Angellyh Yambo Foundation launched earlier this year on Jan. 24, on what would have been Angellyh’s 17th birthday. Her family and friends gathered at her mausoleum in Woodlawn cemetery to mark the official launch of foundation. Founded by her aunt, Mary Hernandez, who is also the CEO, other family members are also involved. The foundation was created with the goal of helping raise awareness about gun violence, among other aims. The family is working with the staff of Angellyh’s former high school, University Prep Charter High School, where they plan to host an anti-bullying program as well as parent and children’s workshops.

Angellyh’s art teacher, Courtney Watson, said she spent a lot of time with Angellyh when she was a student at the school and afterwards. When Angellyh began returning for visits, even after she began high school, Watson said she would bring in her artwork to show to her former teacher. She also explained that Angellyh would also use the art room to work on any of her upcoming artworks.

Watson said one of the last projects Angellyh worked on was part of an “Alice in Wonderland” series which depicted the Mad Hatter’s tea party in black and white. “She was just an incredible artist,” Watson said. “She had a different eye. She just saw things differently. Her approach to her artistic process was something not many at her age would have.”

Sorden said during her visits back to her elementary school, Angellyh would often sit down with her and talk to her about everything ranging from her Sweet 16 celebration to college. Sorden said her last memory of Angellyh is of her walking to her office door to tell her that her Sweet 16 pictures weren’t out yet and how she planned to show them to her once they were ready. “That’s like the most vivid memory I have of, like, hearing her voice and seeing her,” said Sorden.

Angellyh’s passion for the arts was well known it seems as was her unique artistic approach, and she would tell people she was her own favorite artist. Christina Rivera, guidance counselor at the school, said, “I’m just happy that, as a community, we were able to give her a place where she felt safe to come back and just be.”

The school’s art room is now officially named “The Angellyh Yambo Art & Design Room” and the school also has a “Glam Squad” in Angellyh’s honor, made up of current students who also have an interest in art. During the event, the squad recited a poem they had written, entitled, “What Art and Design Means to Me.”

Aside from her love of art, Angellyh also reportedly loved make-up and fashion. Referring to the art room’s activities, Sorden explained, “We wanted to make it so that it can be art, but it could also have the option of make-up, hair, and other things like that.”

As reported, students at University Prep Charter School held “A March for Angellyh” in her memory on June 8, last year during Gun Violence Awareness Month. It was one of many other rallies held across the borough and City opposing gun violence. The students chanted “Enough is Enough!” as they marched around the school block.

As reported, Jeremiah Ryan was charged last year with the murder and attempted murder of Angellyh. Two other students were also shot during the incident. During the shooting, Ryan allegedly used a “ghost gun,” a firearm made from components purchased online with no serial number and which aren’t traceable. He is due back in court in June.

Despite such violent tragedies like the one which resulted in Angellyh’s death, gun crime has been gradually dropping in New York City and in The Bronx, compared to what it had been in 2021. So far this year in The Bronx, according to NYPD data, there have been 101 shooting victims compared to 157 at the same time last year, and so far this year, there have been 81 shooting incidents in the borough, compared to 135 shooting incidents at the same time last year.

In February 2022, U.S. President Joe Biden visited New York to discuss with local elected officials how best to combat the proliferation of ghost guns across the country. Ghost guns are firearms that can be purchased online in parts and later assembled. As reported, in April 2022, a Norwood man was sentenced to two years for possession of ghost guns in his home. Mayor Eric Adams had called, earlier that year, for the cancellation of the country’s largest ghost gun supplier.

Later in 2022, landmark gun legislation was either introduced or passed at nearly every level of government in the wake of a series of  mass shootings, across the country, including in Buffalo, NY, but not without challenges to the laws by Republicans. On June 6, New York State passed a comprehensive 10-bill package closing critical gun law loopholes exposed in the Buffalo and Uvalde mass shootings. Legislation S.9458/A.10503 bars the purchase of semi-automatic rifles by anyone under 21 by requiring a license. Legislation S.9407-B/A.10497 prohibits the purchase of body armor with the exception of those in specified professions.

Legislation S.9113-A./A.10502 expands the list of people who can file Extreme Risk Protection Orders (ERPOs) and requires law enforcement to file ERPOs under a specified set of circumstances. The package also strengthens crime reporting; closing “other gun” loopholes; requires the microstamping of new semi-automatic pistols; eliminates grandfathering of high-capacity feeding devices; and requires social media companies to improve the response to and reporting of hateful content.

Two days later, on June 8, federal legislators in the House of Representatives voted 223 to 204 in what has been called an unprecedented bipartisan bill, the “Protecting our Kids Act,” which, among other measures, if it passes in the U.S. Senate, will also raise the age to buy semi-automatic rifles from 18 to 21, and will restrict the sale of large-capacity ammunition magazines. It was received in the U.S. Senate on June 9, 2022.

Norwood News readers later weighed in on whether they believed the new laws would have any impact on gun violence in The Bronx. On Feb. 24, this year, Deputy Mayor Phil Banks, Police Commissioner Keechant Sewell, FDNY Commissioner Laura Kavanagh and other city officials held a press conference to discuss public safety in New York City. The press conference can be watched above.

On April 8, on the first anniversary of Angellyh’s death, the intersection of Bailey Place and Bailey Avenue in Kingsbridge Heights was officially renamed “Angellyh Marieh Yambo Way” during an unveiling ceremony attended by a large group of family, friends, and elected officials, including New York City Mayor Eric Adams.

Back at her elementary school, reflecting on Angellyh’s sudden and shocking death, Sorden said, “When this happened, it hit really hard. I didn’t want it to be in vain.” She added, “So I needed to do something to honor her existence. She is a Concourse Village student forever.”
