City of Fall River settles lawsuit over 2016 death after in police custody

The City of Fall River has settled a lawsuit concerning a man who later died after being in police custody.

According to Ben Burke of The Public’s Radio 89.3FM, Fall River will pay the family of then 48-year-old Scott Macomber $315,000 as part of a settlement that was reached last month in a civil rights lawsuit over Macomber’s death after being placed in police custody.

In the agreement, Fall River “maintains that the family’s allegations of wrongdoing are factually and legally without merit.”

In a lawsuit filed in April of 2019, Barbara Robinson, the estate representative and then partner of the deceased, contended in the document that on May 16, 2016, officers entered Macomber’s home without a search warrant or consent to arrest his cousin on outstanding warrants. The suit accused officers of using excessive force by beating, restraining, and repeatedly tasing Macomber who later went into cardiac arrest and died later that day.

The Bristol County District Attorney’s office concluded in March of 2017 that the level of force used by the Fall River Police in the death of Macomber was not excessive and did not cause his death. The DA concluded that Macomber resisted arrest that led to a struggle with police officers and non-lethal force being used by officers. The autopsy report concluded that Macomber’s death was the result of cardiac dysrhythmia due to hypertensive and atherosclerotic cardiovascular disease.

The BCDA report stated the following:

At approximately 11:30 a.m. on May 16, 2016, Frederick Garfield walked into the Fall River Police station and spoke with Officer Matthew Pacheco who was working the front desk. Garfield told Pacheco that his ex-girlfriend, Lisa McNally, had several outstanding arrest warrants and that she was staying at an apartment on Mount Hope Avenue in Fall River. Officer Pacheco relayed Garfield’s information to another Fall River Officer, Joshua Carreiro, in the Fall River Police Department’s Special Operations. Officer Pacheco confirmed through the state-wide warrant management system that McNally had outstanding warrants and he provided that information to Officer Carreiro.

Officer Carreiro knew Lisa McNally from prior dealings with her. Officer Carreiro had no prior dealings with Garfield before meeting Garfield at the station. Garfield described some of his issues with McNally and he told Carreiro that McNally was living with her cousins. Garfield said that McNally would not come outside if she knew the police were outside and that if the police tried to speak with the occupants of the apartment, the occupants would lie for her. Garfield believed McNally would run from the police if she was caught outside and that her cousins, “Barbie and Scott,” would try to hide her. Garfield volunteered to assist police in the arrest of McNally by drawing her out of the dwelling.

Officer Carreiro informed police dispatch what he was going to do. He requested assistance from two additional patrol officers and asked them to stand by in the vicinity of Mount Hope Avenue and to respond if he needed them.

At Mount Hope Avenue, it took some time before McNally came out of the apartment. Officer Carreiro drove past the address before he parked on an adjacent street. From this location, Officer Carreiro saw Garfield and McNally come out of the building. Upon seeing McNally, Officer Carreiro recognized her “right away.” Carreiro approached in his vehicle, but McNally noticed him right away and she quickly ran toward the apartment door entrance.

Officer Carreiro, in full uniform, exited and ran after McNally. Carreiro chased McNally on foot as she ran back to the building. He shouted to her, saying, “Lisa stop, you have warrants.”

McNally got to the door of the building; she entered and slammed the door on Carreiro who was right behind her. McNally continued to the first floor apartment, entered and closed the door behind her. Carreiro immediately came to the door, turned the knob and tried to push open the door, but was met with resistance. As Carreiro tried to open the door, and follow her into the as apartment he could feel people on the inside pushing back on the door. Carreiro forced the door open a crack and got a quick glimpse of a woman, who was not McNally, pushing the door shut.

The door quickly slammed shut again and he heard the click of the lock. Carreiro couldn’t understand why McNally was so intent on running and he yelled to her…”Lisa don’t do this, it’s only warrants.”

Carreiro was able to force the locked door open and enter the apartment. Inside, he found a woman, who was unfamiliar to him, behind the door. She began to shout at the officer and Scott Macomber emerged from a room. Macomber approached Carreiro in the interior of the apartment and came into physical contact with the officer, in an effort to keep Carreiro from getting to McNally. The apartment occupants were yelling at the officer. Carreiro asked where Lisa was, and the occupants denied that Lisa was in the apartment. Along with Scott was Macomber, the two women were identified as Barbara Robinson and Jennifer Bernadini. Bernadini had a young child with her in the apartment.

The two back-up officers responded to the apartment to assist Officer Carreiro. After officers arrested Ms. McNally, Officer Carreiro turned his attention to Mr. Macomber, who had interfered with him when Carreiro was searching for McNally inside of the apartment, Macomber struggled with the officers, causing a physical confrontation in the living room of the apartment. During the confrontation one of the officers unholstered his Taser weapon and warned Mr. Macomber that if he didn’t stop he would be tased. Mr. Macomber did not stop, despite several warnings, and as a result an Officer applied the Taser directly to the Macomber’s body’ in order to gain control over Mr. Macomber. Evidence downloaded from the “Taser Sync” showed three separate applications of the Taser. The first lasted three seconds, the second lasted two seconds and the third lasted one second.

Mr. Macomber was handcuffed and taken into custody. In accordance with Fall River Police Department protocol, an ambulance was immediately summoned even though Mr. Macomber was making no complaints of pain and was exhibiting no signs of distress. Police took Macomber and McNally and placed them into separate police cruisers. While in the cruiser, Macomber asked for a window to be rolled down. Shortly thereafter, he went into medical distress. Fall River Rescue arrived on the scene and EMTs attended to Mr. Macomber and transported him to St. Anne’s Hospital where he was pronounced dead at 1:20 P.M. An autopsy performed by the Chief Medical Examiner of the Commonwealth determined the cause of death to be Cardiac Dysrhythmia due to hypertensive and atherosclerotic cardiovascular disease and that the manner of Mr. Macomber’s death was natural.

Daily Report – Bitcoin and Market Update (May 4 2022) – The Birb Nest

HTF 12H:

The middaily chart has seen a promising session close, giving a brief partial confirmation for the wedge pattern breakout. However, the bearish case has not disappeared just yet.

Firstly, the wedge pattern has formed and just seen its candle breakout outside the upper bound – the descending trend line, marking dynamic levels of resistance as the traders continued to lower the asks down the slope. The first successful close is a promising trigger for a potential breakout trade. However, one needs to acknowledge an overall lack of trend and order in the movement over the past few months. Caution needs to be raised.

Maintaining high correlation to the large cap equities, the latter show off quite a poor performance – over many decades, the market closed the 4th of May only ~38% bullish and ~62% of the time in a bearish manner returning negative result. The seasonality does not favor bitcoin on this day for the current context, relying on the historical records.

Then, the CTF Trailer Stop remains at $41198. As long as bulls do not reclaim this region, the bears maintain the upper vote in the market. The bulls need a close of the day or week outside the said Stop level $41198, in order to re-gain the control over the market. If that is the case indeed, then the potential price objectives at $45478-$46572 activate.

MTF 4H:

The MTF chart has recorded a local bounce off the $37500 support with a +3.25% increase.

Nearing a local resistance area at 39000 USD, bitcoin will need a stronger push outside the prior pivot to ensure there’s enough of momentum to pursue higher targets.

The CTF Trailer Stop rests at $39527 and is the main level needed to break by the bulls, in order to re-gain the upper vote in the market over the near-term time frames.

These levels could be anticipated to serve as level-to-level references. In other words, when one level is breached, the next one in the direction of the movement

LTF 1H:

The hourly chart shows a local consolidation movement between the 37500 USD lows and the 39000 USD highs.

The Baseline average ascends quite sharply, which is indicative of the near-term momentum strength in the upwards direction. At the same time, it provides mean support at 38600 USD level, which if broken to the downside could lead to further selling pressures.

The price action based support area is defined at 38000-38100 USD, whereas the resistance region is formed at the 39000-39200 USD highs. Those levels could act as form of magnet pulls in the direction of the breakout. A clean break outside the resistance area with a follow-through to the upside on a higher time frame could lead to reliable confirmation of higher price objectives to come tested.

Bitcoin: Active Addresses (EMA 14)

As CryptoQuant explains, the metric stands for “The total number of unique active addresses, inclusive of senders and receivers.”

The EMA14 remains relatively flat, less noise fluctuations. No visible trend or change in the neutral trajectory has been spotted so far.

Hence, this metric is useful in noting that it aligns well with the price indications as the marked has remained flat for the entire 2022 to date period.

Traders could search for triggers and spikes in the active addresses on the on-chain side, which could be indicative of future price movements to an extent.

FEAR/GREED INDEX:

As the sentiment continues to weaken at the 21 points on the index scale, the speculators maintain hopelessness and overly bearish, pessimistic expectations for the next days and weeks of trading. Over pessimistic approach to the markets typicall leads to selling off right into the bottomish price regions, more often than not.

Especially, if accounted for today’s FOMC meeting at 2:00 PM EST where the majority prices in expectations for 75bps rate hikes for the upcoming period of May and June, if the real words from the chairman J. Powell happen to be more dovish (e.g. 50 bps instead of 75bps, or more optimistic outlook shared, slowed inflation rates, etc.) this could lead to somewhat of a relief rally in equities – and in bitcoin/crypto.

Regardless of the speculations, sides taken on the votes, bets for what the FED’s stance today is, caution is advised. Over trading through the news sharing period typically leads to sore under performance and painful losses. Highly recommed to avoid these risky activities at the time knowing the the market has moved sideways for bitcoin – no trend or tendency is clear.

Daily Report – Bitcoin and Market Update (May 11 2022) – The Birb Nest

HTF 12H:

The middaily chart continues to trade within a contracting consolidation sequence, bounded by the lows of 29700 USD support, and the 32600 USD resistance.

Amid the stock market fall and indecision, BTCUSD has claimed a lot of selling pressure through the route of strong correlation to equities. At the moment, bitcoin is considered one of the risk-on assets, similar to the stocks, and it doesn’t help BTC gain on price, when the stocks are falling. The fundamental correlation acts against the bitcoin bulls.

Technically speaking, the chart has continued to decline into the long-term chart pattern (28800-69000 USD) lows, so far confirming an intraweek demand in this region. The bitcoin bulls need to win the battle and defend the support level, a line in the sand. If the last bullish bastion breaks, it is likely that a cascade of protective stop liquidations would trigger, taking the price lower – even into the mid 20000 USD regions. However, such a breakdown would need a technical confirmation with an ugly and definite close of a week below the 28800 USD level. Otherwise, the chances are the late shorts will get trapped.

The CTF Trailer has marked the Stop, invalidation level, at $35652. If this level is reclaimed by the bulls with a daily or a weekly close through to the upside, the bulls would re-gain the control over the market. Otherwise, the selloff may continue – especially, if encouraged by an overall global economy decay.

MTF 4H:

The MTF chart tumbles at the lower end of the volatility-projected region defined for BTC by the BPRO Bads.

Per the historical volatility levels, bitcoin is now projected to trade “healthily” within the 29600-35000 USD zone. This area is defined by the Momentum Bands, derived of the volatility indicators, i.a. standard deviation, which is a measure of risk in the financial world. A clean break outside the expected volatility area may confirm an upcoming acceleration to the upside or to the downside, depending on the direction of the breakout.

Because of the momentum principle, trends have the tendency to persist. It implies that the price trajectory, once moved in specific direction, is likely to continue in this direction. For this reason, I would suggest caution while planning on catching the falling knives in such an unstable environment.

It is after accounting for the supply chain crisis, galloping inflation, rate hiking cycle, Russia-Ukraine war, LUNA and UST tokens collapse. In my view, the marked is too much unstable, to allow any confidence or certainty in bets that just because a coin has decreased a lot, it needs to recover fast. Refer to the momentum principle.

A clean break below the 29600 USD support, may trigger further selling off period into the lower support at 28800 USD, or lower – if encouraged by unfavorable fundamental collapses, like today’s with Terra ecosystem.

LTF 1H:

The hourly chart displays a narrow trading range for intraday price action of bitcoin.

As the Momentum Bands have tightened or converged, an expected volatility has high likelihood to provide traders with a more spectacular breakout anytime soon. A volatility impulse would follow a break outside the projected “normal volatility” area 30000-31800 USD. The direction of the breakout would likely confirm a more decisive trend/trajectory to resurface out of the local stagnancy.

The HTF Trailer 12H is, in my eyes, the most relevant resistance to break for BTCUSD, in order to re-gain the control for the bulls. Otherwise, the market remains under the bearish suppression and the momentum principle encourages downwards continuation.

These levels could be anticipated to serve as level-to-level references. In other words, when one level is breached, the next one in the direction of the movement can be expected to act as the next “magnet”

FEAR/GREED INDEX:

The fear saga continues, as the price takes a punt down amid the Terra system collapse. Regardless of the reasons behind the bitcoin selloff, the risk factor does always need to be accounted for while taking any new positions. The current extreme fear environment does not support any dose of optimism among the speculators at this time, clearly.

Per the graph, rarely ever in bitcoin’s history, has the sentiment been any worse than at the current moment. While soaking in an extreme pessimism at 10-11 points on the sentiment scale, this has a potential (although, uncertain) to become a far end of the capitulation and seemingly 6 months of constant declines in the bitcoin market.

As the volatility factors intensify, so does the risk of being on the wrong side of the trend, facing the chances of losses. However, the territory bitcoin has found itself into right now, has historically brought reversals. This index does not assure the prices can not go any lower. Nonetheless, historically, that sentiment depths is when bitcoin had generated the best buying opportunities.

An overall revulstion of the crypto investors seems to be apparent right now, which often marks more favorable buying opportunities than it came for the sellers. Of course, this has been the theme seen in the charts over the course of the past weeks and months. As explained dozens of times in the past, that was to be expected. Mainly, because the fear/greed index is NOT a timing indicator, like RSI, Stochastic, MACD, etc. Instead, it only informs on the contrarian basis, that bitcoin may be viewed as “cheap” right now. The more extreme panic resurfaces, the “cheaper” the bitcoin prices.

I would highly reconsider opening any of new positions at the moment, as the downwards trend has not cooled off in a confirmatory manner just yet, and the upwards trend has not broken out just yet, as bitcoin remains to reside inside the large 2021-2022 chart pattern, bounded by the 28800 USD lows and the 69000 USD highs.
