Ford Hybrid Engine Recall Leads to Class Action Lawsuit

A Ford hybrid engine recall has caused a vehicle owner to file a class action lawsuit which alleges the recall repairs don’t make the hybrid vehicles safe to drive.

Included in the hybrid engine lawsuit are 2020-2022 Ford Escape, 2022 Ford Maverick and 2021-2022 Lincoln Corsair vehicles equipped with 2.5-liter hybrid engines.

The recall was announced following 23 worldwide reports of underhood hybrid engine smoke and fires.

“In the event of an engine failure, significant quantities of engine oil and/or fuel vapor may be released into the under hood environment and may migrate to and/or accumulate near ignition sources resulting in potential under hood fire, localized melting of components, or smoke.” — Ford recall document

Ford says less than 1% of the hybrid vehicles may have suffered from engine manufacturing problems that could cause engine failures involving breaches of the oil pans or engine blocks.

If the engine fails, engine oil or fuel vapors could build up near or on hot exhaust surfaces and lead to underhood smoke, melting components and fires.

“Of the 23 reports, Ford’s CCRG has categorized the warranty and field reports as: nine describing under hood or vehicle fire, six reporting localized under hood melting, seven describing under hood smoke, and one that did not contain sufficient detail to characterize. Ford is not aware of any reports of accident or injury related to this condition.” — Ford

According to Ford, a driver will know if the engine is failing because metal-to-metal clanking noise will be heard and the vehicle will lose power.

For hybrid vehicle repairs, Ford says the under engine shield will have additional drain holes and the active grille shutter will be modified to redirect or purge the hybrid engine compartment of oil and fuel vapors. This will allegedly reduce the odds of an engine fire, but the class action alleges the repairs don’t work as intended.

The lawsuit also alleges Ford knew or should have known about the hybrid engine fire risk before the vehicles were sold. And while a recall fix has been announced, the plaintiff claims the repairs don’t work.

California plaintiff Anthony Pacheco purchased a Ford Maverick in April 2022, or what the plaintiff calls his “Fire Defect Vehicle.” According to the plaintiff, his Maverick was repaired for free under the hybrid recall, but he claims Ford’s engineers are wrong and the “fix” won’t do anything to remedy the issue.

The Ford hybrid engine lawsuit asserts Ford should offer every owner a buyback of their vehicle based on the Blue Book value on the day before the recall was announced. Or at the least, Ford should offer a comparable loaner vehicle.

The Ford hybrid engine class action lawsuit was filed in the U.S. District Court for the Eastern District of Michigan: Anthony Pacheco v. Ford Motor Company.

The plaintiff is represented by Hagens Berman Sobol Shapiro LLP, and The Miller Law Firm PC.

Sustainable Development and Land Use Update – August 2022 #3 | Allen Matkins – JDSupra

Proposed vineyard redevelopment at center of debate over future of Napa’s wine industry

Bullet San Francisco Chronicle – August 17

The proposed redevelopment of a vineyard in south Napa County is at the center of a heated political debate over land use in the area. The vineyard’s owners say it is “blighted,” no longer viable for grape growing. They want to redevelop the land for industrial use, such as wine warehouses used for fulfillment or storage. But Napa Valley preservationists, including wine and agriculture groups like the Napa County Farm Bureau and Napa Valley Vintners, are worried that could set a dangerous precedent of converting protected land and kick-start urban sprawl. In November, residents of American Canyon, located at the south end of Napa County, will vote on the first significant step toward redevelopment.

Two more Southern California cities halt warehouse expansion

Bullet American Journal of Transportation – August 18

Two more Southern California cities have voted to enact and extend temporary moratoriums on new industrial developments to study the environmental and health impact on residents. By unanimous vote, the Norco city council last Wednesday enacted a 45-day moratorium on the construction of new industrial areas and warehouses. Earlier in the week, Pomona city officials extended a similar pause on development for an additional 10-and-a-half months.

Bullet KRON – August 22

On August 18, the California High-Speed Rail Authority board voted unanimously to approve the environmental impact report along the 49-mile section from San Francisco to San Jose. The high-speed rail line will feed into San Jose through Diridon Station, which is set to become a major transit hub with BART’s expansion from the north. To connect the Central Valley to Gilroy, and then San Jose, the project will require tunneling through Pacheco Pass.

Hotel-to-housing conversions proliferate

Bullet Urban Land – August 15

Numerous outdated hotel properties are being reborn as residences as multifamily developers and investors looking for a quick and cost-effective way to produce more housing snap them up for conversion to apartments. “Even though they are paying above market for assets, investors feel like they’re getting a bargain because it can be cheaper to convert a hotel to apartments than to acquire or build multifamily projects,” Geraldine Guichardo, head of global research for JLL’s Hotels & Hospitality Group and Americas Hotels Research, Living Platform USA explains. The average cost per unit for hotel-to-housing conversions in California, for example, is $130,000, compared with the $380,000 to $570,000 per unit for new construction, according to the California Department of Housing and Community Development.

Valley Water discusses drought solutions during water summit | News | Mountain View Online |

The Santa Clara Valley Water District hosted a summit Friday morning in Santa Clara, bringing together elected officials and organizations across the Bay Area to discuss solutions to statewide water problems as California experiences its third consecutive year of a severe drought emergency.

Water Summit 2022 focused on both short- and long-term solutions and mitigations to water shortages.

Aaron Baker, the chief operating officer for water utility at Valley Water, said such solutions are needed to help the region through the current drought.

For Valley Water, some of the solutions include conservation programs. The water district offers rebates for scrapping lawns in favor of low water use and environmentally friendly options, and rebates to those irrigating with graywater diverted from laundry use. Landscaping rebates can reach up to $3,000 for residential sites and $100,000 for commercial, institutional or industrial sites, depending on the water use savings.

The water district also offers free conservation devices to single-family and multi-family homes and commercial properties.

“We have programs for every home and business in the county,” said Kirsten Struve, assistant officer for the water supply division at Valley Water.

The district has seen success with its conservation outreach, citing more than 1 million square feet of lawn that has been converted to more environmentally and drought friendly landscaping and that the organization now has 22 conservation programs operating.

As the summit turned to more long-term solutions, Chris Hakes, the deputy operating officer for dam safety and capital delivery for Valley Water, discussed the Anderson Dam Seismic Retrofit Project.

Anderson Reservoir, the largest groundwater recharge reservoir for Valley Water, is undergoing a dam tunnel project as part of a federally mandated project to make the dam up to current safety standards. The project is expected to be completed in 2024.

Following the tunnel, the project will continue into future phases that include reconstructing the embankment and replacing the spillway, keeping the downstream Morgan Hill area safe. The project is expected to be completed by 2031 or 2032.

Ryan McCarter, the Pacheco project manager for Valley Water, also outlined another reservoir project that the organization believes could help with water storage to mitigate the shortages of a drought.

McCarter said that the Pacheco Reservoir, located in southeast Santa Clara County, is going to be expanded and allow the county to double its capacity for storage. The project will move a new dam upstream and utilize an existing pipeline to bring water into the region.

While the project has already received more than $500 million from the state, Valley Water is continuing to look for grants and partnerships to fund the expansion of the Pacheco reservoir.

The project will allow the reservoir to hold enough water for 1.4 million people for one year, while also improve downstream habitats for 10 miles.

Struve outlined the organization’s other major focus for long-term water solutions: purification.

The process involves purifying the water typically disposed into the Bay to be reused. Valley Water is looking into expanding purification plants, with the goal of using recycled water to cover 10 percent of water use in future years.

The project would involve a 20-mile pipeline connecting wastewater treatment plants with further purification centers and recharge systems.

Another challenge facing purification? Public perception. Valley Water asked attendees to voice their support for the project to others to try to change the perception of recycled water as dirty, given the intense purification system and modern technology involved.

Other speakers at the summit also focused on the importance of hiring workers to the water industry with diversity and inclusion in mind, including through a focus on students from historically Black colleges and universities through a partnership with the Silicon Valley Leadership Group.

Valley Water Board of Directors chair pro tem John Varela ended the summit by calling on all to spread the message that social justice, water recycling and water conservation are essential to California making it through droughts.

With the enhanced efforts and vision, the panchayats will definitely be the driving force of ‘Swayampurna Goa’ mission, he observed.

“I am sure that they will carry out their responsibilities with devotion and care,” he hoped.

State BJP president Sadanand Tanawade said that 128 to 130 village panchayats out of the 186 panchayats for which elections were conducted have BJP-supported panels on them.

“If you count our alliance partners like Maharashtrawadi Gomantak Party, this number could very well go up to 140,” he added, stating that some others like Francisco Xavier ‘Mickky’ Pacheco are also keen to join the BJP, and in that case the number of panchayats, which have BJP panels on them could further increase.

Tanawade also told ‘The Navhind Times’ that after the declaration of the panchayat election results, many winners had met either him or the Chief Minister.

“Now, however, after the elections for the posts of sarpanch and deputy sarpanch, we have asked our MLAs in the respective constituencies to meet all those sarpanches and deputy sarpanches supported by us and congratulate them,” he maintained, stating that in talukas like Sattari, Bicholim, Sanguem and Canacona, the BJP had captured cent per cent panchayats, while the party has conquered near 100% panchayats in talukas like Pernem, Sanvordem, Quepem, Priol, Madkai and so on.

Interestingly, a large number of sarpanches and deputy sarpanches have been elected unopposed.

Furthermore, most of the MLAs were successful in retaining some of their panchayats, while some other legislators received setback.

Although the panchayat elections were not held at the party level, the equations of several village panchayats were altered, mostly in favour of the ruling party.
